中共中央、國務院:行業協會商會擬后年與行政機關脫鉤

  新華(hua)社北京7月(yue)8日電 中共中央(yang)辦公廳、國務(wu)院辦公廳近(jin)日印發了《行業協(xie)會(hui)商(shang)會(hui)與行政機關(guan)脫鉤總(zong)體方案》,并發出通知,要求各(ge)地區各(ge)部門結合實際認真貫徹(che)執行。

  《行(xing)業協會商會與行(xing)政機關脫鉤總體(ti)方案》全文如下。

  行(xing)業(ye)(ye)協會(hui)商(shang)(shang)會(hui)是我國(guo)經濟建設(she)和社(she)(she)(she)會(hui)發展(zhan)的(de)重要力量(liang)。改(gai)革(ge)開放以來,隨著(zhu)社(she)(she)(she)會(hui)主(zhu)義市場經濟體(ti)制的(de)建立和完善,行(xing)業(ye)(ye)協會(hui)商(shang)(shang)會(hui)發展(zhan)迅速,在(zai)為政(zheng)(zheng)府提供咨詢、服務企業(ye)(ye)發展(zhan)、優化資(zi)源配(pei)置、加強行(xing)業(ye)(ye)自律、創(chuang)(chuang)新社(she)(she)(she)會(hui)治(zhi)(zhi)理、履行(xing)社(she)(she)(she)會(hui)責(ze)任(ren)等方(fang)面(mian)發揮(hui)了積(ji)極作(zuo)用。目前,一些行(xing)業(ye)(ye)協會(hui)商(shang)(shang)會(hui)還存在(zai)政(zheng)(zheng)會(hui)不分、管(guan)辦一體(ti)、治(zhi)(zhi)理結(jie)構不健全(quan)(quan)、監督管(guan)理不到位(wei)、創(chuang)(chuang)新發展(zhan)不足、作(zuo)用發揮(hui)不夠等問題。按照《中共中央關(guan)于全(quan)(quan)面(mian)深化改(gai)革(ge)若干重大問題的(de)決定(ding)》、《國(guo)務院機(ji)構改(gai)革(ge)和職能轉(zhuan)變方(fang)案》有(you)關(guan)精神和工作(zuo)部署,為加快(kuai)轉(zhuan)變政(zheng)(zheng)府職能,實現行(xing)業(ye)(ye)協會(hui)商(shang)(shang)會(hui)與行(xing)政(zheng)(zheng)機(ji)關(guan)脫(tuo)鉤,促進行(xing)業(ye)(ye)協會(hui)商(shang)(shang)會(hui)規范發展(zhan),制定(ding)本方(fang)案。

  一、總體要求和(he)基本原(yuan)則

  (一)總體(ti)要求

  貫徹落實黨的(de)(de)十八大和(he)十八屆二中(zhong)(zhong)、三中(zhong)(zhong)、四中(zhong)(zhong)全會(hui)(hui)(hui)(hui)(hui)(hui)精(jing)神,加(jia)快形成政社(she)分(fen)(fen)開(kai)、權責明(ming)確、依(yi)(yi)法(fa)(fa)自(zi)(zi)(zi)治的(de)(de)現代社(she)會(hui)(hui)(hui)(hui)(hui)(hui)組織體制(zhi)(zhi),理(li)清政府、市場(chang)、社(she)會(hui)(hui)(hui)(hui)(hui)(hui)關(guan)(guan)(guan)系,積極穩妥推進行(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)(hui)與(yu)(yu)行(xing)政機關(guan)(guan)(guan)脫鉤(gou),厘清行(xing)政機關(guan)(guan)(guan)與(yu)(yu)行(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)(hui)的(de)(de)職能邊界,加(jia)強綜(zong)合監管和(he)黨建工作,促(cu)進行(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)(hui)成為(wei)依(yi)(yi)法(fa)(fa)設立(li)、自(zi)(zi)(zi)主辦會(hui)(hui)(hui)(hui)(hui)(hui)、服務為(wei)本(ben)、治理(li)規范、行(xing)為(wei)自(zi)(zi)(zi)律的(de)(de)社(she)會(hui)(hui)(hui)(hui)(hui)(hui)組織。創新行(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)(hui)管理(li)體制(zhi)(zhi)和(he)運(yun)行(xing)機制(zhi)(zhi),激發內在活力(li)和(he)發展(zhan)動力(li),提升行(xing)業(ye)服務功能,充(chong)分(fen)(fen)發揮行(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)(hui)(hui)在經(jing)濟發展(zhan)新常(chang)態中(zhong)(zhong)的(de)(de)獨特優勢和(he)應有作用。

  (二)基本原則

  堅(jian)持社會(hui)化(hua)(hua)(hua)、市(shi)場(chang)(chang)化(hua)(hua)(hua)改革方向。圍繞(rao)使(shi)市(shi)場(chang)(chang)在資源(yuan)配置中起決(jue)定性作用和(he)更好發(fa)揮政(zheng)府作用,改革傳統的(de)行政(zheng)化(hua)(hua)(hua)管理方式,按照(zhao)去行政(zheng)化(hua)(hua)(hua)的(de)要求(qiu),切斷行政(zheng)機關和(he)行業協(xie)會(hui)商會(hui)之(zhi)間(jian)的(de)利益(yi)鏈(lian)條,建(jian)立新型管理體制和(he)運(yun)行機制,促進和(he)引導行業協(xie)會(hui)商會(hui)自主運(yun)行、有序競爭、優化(hua)(hua)(hua)發(fa)展。

  堅持法(fa)制(zhi)化、非營利原(yuan)則。加快行(xing)業協會(hui)商(shang)會(hui)法(fa)律制(zhi)度建設,明確(que)脫鉤后的法(fa)律地位(wei),實現依法(fa)規范運(yun)行(xing)。建立準(zhun)入和退出機制(zhi),健全(quan)綜合監(jian)管(guan)體系。各級政府要明確(que)權力邊(bian)界,實現權力責任統一、服務(wu)監(jian)管(guan)并重。按照非營利原(yuan)則要求,規范行(xing)業協會(hui)商(shang)會(hui)服務(wu)行(xing)為,發揮對會(hui)員(yuan)的行(xing)為引導、規則約束(shu)和權益維(wei)護作用。

  堅持服務(wu)發(fa)展、釋(shi)放市場活力(li)。提升行(xing)(xing)業(ye)(ye)協(xie)會(hui)商會(hui)專業(ye)(ye)化(hua)水(shui)平和能力(li),推動服務(wu)重(zhong)心從政府轉向(xiang)企業(ye)(ye)、行(xing)(xing)業(ye)(ye)、市場。通(tong)過(guo)提供(gong)指(zhi)導、咨(zi)詢、信息等服務(wu),更好地為(wei)企業(ye)(ye)、行(xing)(xing)業(ye)(ye)提供(gong)智力(li)支撐,規范市場主體(ti)行(xing)(xing)為(wei),引導企業(ye)(ye)健康有序(xu)發(fa)展,促進產業(ye)(ye)提質增效升級(ji)。

  堅持試(shi)點先行、分(fen)步穩妥推進(jin)。在中央和地方(fang)分(fen)別開展(zhan)試(shi)點,設置必要的(de)過渡期,積極(ji)探索(suo),總(zong)結經驗(yan),完善措施,逐步推開。根據(ju)行業(ye)協會(hui)商會(hui)不同(tong)情況,因(yin)地因(yin)業(ye)因(yin)會(hui)逐個縝密(mi)制定脫(tuo)(tuo)鉤實(shi)施方(fang)案(an),具(ju)體安(an)排、具(ju)體指導(dao)、具(ju)體把握,確保(bao)脫(tuo)(tuo)鉤工作平穩過渡、有序推進(jin)。

  二(er)、脫鉤(gou)主體和范圍(wei)

  脫鉤的(de)主(zhu)(zhu)體(ti)是各級行(xing)(xing)政(zheng)機關(guan)與(yu)其主(zhu)(zhu)辦、主(zhu)(zhu)管、聯(lian)系(xi)、掛靠的(de)行(xing)(xing)業協會(hui)商會(hui)。其他(ta)依(yi)照(zhao)和參照(zhao)公務員(yuan)法管理的(de)單位與(yu)其主(zhu)(zhu)辦、主(zhu)(zhu)管、聯(lian)系(xi)、掛靠的(de)行(xing)(xing)業協會(hui)商會(hui),參照(zhao)本方案執行(xing)(xing)。

  同(tong)時具有(you)以下特征的行(xing)業協(xie)(xie)會(hui)商會(hui)納(na)入脫鉤范圍:會(hui)員主體為(wei)從(cong)事相同(tong)性質(zhi)經濟活(huo)動的單位、同(tong)業人員,或同(tong)地域的經濟組織;名稱以“行(xing)業協(xie)(xie)會(hui)”、“協(xie)(xie)會(hui)”、“商會(hui)”、“同(tong)業公會(hui)”、“聯(lian)合會(hui)”、“促(cu)進會(hui)”等(deng)字樣為(wei)后(hou)綴;在民政部門登記為(wei)社會(hui)團(tuan)體法人。

  個別承擔特殊職(zhi)能(neng)的全國性行業協會商(shang)會,經中央(yang)辦公廳、國務院辦公廳批準,另行制定改(gai)革辦法。

  三(san)、脫鉤(gou)任務(wu)和措(cuo)施

  (一)機構分離(li),規范綜合(he)監(jian)管關系(xi)

  取消行(xing)(xing)政機關(guan)(guan)(包括下(xia)屬單位)與行(xing)(xing)業協(xie)會商(shang)會的(de)主辦(ban)、主管、聯(lian)系和(he)掛靠關(guan)(guan)系。行(xing)(xing)業協(xie)會商(shang)會依法(fa)直接(jie)登(deng)記和(he)獨(du)立運行(xing)(xing)。行(xing)(xing)政機關(guan)(guan)依據職能對(dui)行(xing)(xing)業協(xie)會商(shang)會提供服務并依法(fa)監管。

  依(yi)法保障行(xing)(xing)(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)獨立平等(deng)法人地位(wei)。按照有(you)利(li)于(yu)行(xing)(xing)(xing)業發(fa)展和自愿互惠原則,對行(xing)(xing)(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)之間、行(xing)(xing)(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)與其他社會(hui)(hui)組織之間的代(dai)管協(xie)管掛靠關系進行(xing)(xing)(xing)調整,并納(na)入章程(cheng)予以規范。鼓勵行(xing)(xing)(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)優化整合,提高服務效率和水(shui)平。

  調整行(xing)(xing)業(ye)(ye)(ye)協會(hui)(hui)商會(hui)(hui)與(yu)其代管(guan)(guan)的(de)事(shi)(shi)業(ye)(ye)(ye)單(dan)位的(de)關(guan)系。行(xing)(xing)業(ye)(ye)(ye)協會(hui)(hui)商會(hui)(hui)代管(guan)(guan)的(de)事(shi)(shi)業(ye)(ye)(ye)單(dan)位,并入(ru)行(xing)(xing)業(ye)(ye)(ye)協會(hui)(hui)商會(hui)(hui)的(de),注(zhu)銷(xiao)事(shi)(shi)業(ye)(ye)(ye)單(dan)位法人資(zi)格,核銷(xiao)事(shi)(shi)業(ye)(ye)(ye)編(bian)制(zhi),并入(ru)人員按照行(xing)(xing)業(ye)(ye)(ye)協會(hui)(hui)商會(hui)(hui)人員管(guan)(guan)理方式(shi)管(guan)(guan)理;不能并入(ru)行(xing)(xing)業(ye)(ye)(ye)協會(hui)(hui)商會(hui)(hui)的(de),應當與(yu)行(xing)(xing)業(ye)(ye)(ye)協會(hui)(hui)商會(hui)(hui)脫鉤,根據(ju)業(ye)(ye)(ye)務關(guan)聯性,在精(jing)簡的(de)基礎上劃轉(zhuan)到相關(guan)行(xing)(xing)業(ye)(ye)(ye)管(guan)(guan)理部門(men)管(guan)(guan)理,并納入(ru)事(shi)(shi)業(ye)(ye)(ye)單(dan)位分類(lei)改革。

  行(xing)政機(ji)關或事業(ye)單位與行(xing)業(ye)協(xie)(xie)會(hui)商(shang)會(hui)合署辦公的,逐(zhu)步將(jiang)機(ji)構、人員和(he)資(zi)產分開,行(xing)政機(ji)關或事業(ye)單位不再承擔行(xing)業(ye)協(xie)(xie)會(hui)商(shang)會(hui)職能。

  (二)職(zhi)能分(fen)離,規范行政(zheng)委托(tuo)和(he)職(zhi)責分(fen)工關(guan)系(xi)

  厘清行(xing)政(zheng)(zheng)機關(guan)與(yu)行(xing)業協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)的(de)職(zhi)(zhi)能(neng)。剝離(li)行(xing)業協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)現有的(de)行(xing)政(zheng)(zheng)職(zhi)(zhi)能(neng),法律法規(gui)另(ling)有規(gui)定的(de)除外。業務主管單位(wei)對剝離(li)行(xing)業協(xie)會(hui)(hui)(hui)商(shang)(shang)會(hui)(hui)(hui)有關(guan)行(xing)政(zheng)(zheng)職(zhi)(zhi)能(neng)提出具(ju)體意見(jian)。

  加快轉移(yi)適合由行(xing)(xing)業協會商(shang)(shang)會承(cheng)擔(dan)的(de)職(zhi)能(neng)。行(xing)(xing)政(zheng)機關對適合由行(xing)(xing)業協會商(shang)(shang)會承(cheng)擔(dan)的(de)職(zhi)能(neng),制定清單(dan)目(mu)錄,按程(cheng)序(xu)移(yi)交(jiao)行(xing)(xing)業協會商(shang)(shang)會承(cheng)擔(dan),并制定監(jian)管(guan)措施、履(lv)行(xing)(xing)監(jian)管(guan)責任。

  (三)資產(chan)財務分離,規范財產(chan)關(guan)系

  行(xing)(xing)業協會商會應(ying)執行(xing)(xing)民(min)間非營利組織(zhi)會計制度,單獨(du)建賬(zhang)、獨(du)立(li)核算。沒(mei)有(you)獨(du)立(li)賬(zhang)號、與行(xing)(xing)政(zheng)機關會計合賬(zhang)、財務由(you)行(xing)(xing)政(zheng)機關代管或(huo)集中(zhong)管理的行(xing)(xing)業協會商會,要(yao)設立(li)獨(du)立(li)賬(zhang)號,單獨(du)核算,實行(xing)(xing)獨(du)立(li)財務管理。

  對原有財(cai)政(zheng)(zheng)預算支(zhi)持的(de)(de)(de)全國性行業協(xie)會商會,逐步通過(guo)政(zheng)(zheng)府購買服務等方(fang)式支(zhi)持其發(fa)展。自(zi)2018年(nian)起,取消(xiao)全國性行業協(xie)會商會的(de)(de)(de)財(cai)政(zheng)(zheng)直接撥(bo)款(kuan)(kuan),在(zai)此之前,保留原有財(cai)政(zheng)(zheng)撥(bo)款(kuan)(kuan)經費渠道不變。為(wei)鼓勵全國性行業協(xie)會商會加快與行政(zheng)(zheng)機關脫(tuo)鉤(gou),過(guo)渡(du)(du)期(qi)內根據脫(tuo)鉤(gou)年(nian)份,財(cai)政(zheng)(zheng)直接撥(bo)款(kuan)(kuan)額度(du)逐年(nian)遞減。地方(fang)性行業協(xie)會商會的(de)(de)(de)財(cai)政(zheng)(zheng)撥(bo)款(kuan)(kuan)過(guo)渡(du)(du)期(qi)和過(guo)渡(du)(du)辦法,由各地自(zi)行確定,但過(guo)渡(du)(du)期(qi)不得超過(guo)2017年(nian)底(di)。用于(yu)安置歷次政(zheng)(zheng)府機構改革(ge)分流人員的(de)(de)(de)財(cai)政(zheng)(zheng)資金,仍按原規(gui)定執行。

  按(an)照財(cai)政部門(men)、機(ji)關事務主管(guan)部門(men)統一部署和(he)有(you)關規定,各業務主管(guan)單位對其主管(guan)的行(xing)(xing)(xing)業協(xie)會商(shang)(shang)會財(cai)務資產(chan)狀況進行(xing)(xing)(xing)全面摸底和(he)清查(cha)登記(ji),厘清財(cai)產(chan)歸(gui)屬(shu)。財(cai)政部門(men)會同機(ji)關事務主管(guan)部門(men)按(an)照所有(you)權(quan)、使用權(quan)相分(fen)離的原則,制定行(xing)(xing)(xing)業協(xie)會商(shang)(shang)會使用國有(you)資產(chan)(包括(kuo)無形(xing)資產(chan))管(guan)理辦法,確(que)保國有(you)資產(chan)不流失,同時確(que)保行(xing)(xing)(xing)業協(xie)會商(shang)(shang)會的正常(chang)運(yun)行(xing)(xing)(xing)和(he)發(fa)展(zhan)。

  行(xing)業協(xie)會(hui)商(shang)會(hui)占用的行(xing)政(zheng)辦公(gong)(gong)用房,超出規(gui)定(ding)面積標準的部分(fen)(fen)限期(qi)清(qing)理騰退;符合規(gui)定(ding)面積標準的部分(fen)(fen)暫由(you)行(xing)業協(xie)會(hui)商(shang)會(hui)使用,2017年底前(qian)按《中共中央(yang)辦公(gong)(gong)廳、國務院辦公(gong)(gong)廳關于黨政(zheng)機關停止新建樓(lou)堂館所(suo)和(he)清(qing)理辦公(gong)(gong)用房的通知》及有(you)關規(gui)定(ding)清(qing)理騰退,原則(ze)上應實現辦公(gong)(gong)場(chang)所(suo)獨立。具體(ti)辦法由(you)機關事務主管部門會(hui)同有(you)關部門制(zhi)定(ding)。

  (四)人員管理分離,規范用人關系

  行業協會商會具有人(ren)事自主權,在人(ren)員(yuan)管理上與(yu)原主辦、主管、聯系(xi)和(he)掛靠單位(wei)脫鉤(gou),依(yi)法依(yi)規(gui)建(jian)立(li)規(gui)范用人(ren)制度,逐步實行依(yi)章程自主選(xuan)人(ren)用人(ren)。

  行(xing)政(zheng)機關不(bu)(bu)得推薦、安排在職(zhi)(zhi)和退(tui)(tui)(離)休(xiu)公務(wu)員到(dao)行(xing)業協會(hui)(hui)商會(hui)(hui)任(ren)職(zhi)(zhi)兼(jian)(jian)(jian)職(zhi)(zhi)。現(xian)職(zhi)(zhi)和不(bu)(bu)擔任(ren)現(xian)職(zhi)(zhi)但(dan)未辦(ban)理退(tui)(tui)(離)休(xiu)手續的(de)黨政(zheng)領導干部及在職(zhi)(zhi)工(gong)作人員,不(bu)(bu)得在行(xing)業協會(hui)(hui)商會(hui)(hui)兼(jian)(jian)(jian)任(ren)職(zhi)(zhi)務(wu)。領導干部退(tui)(tui)(離)休(xiu)后三年(nian)內一般不(bu)(bu)得到(dao)行(xing)業協會(hui)(hui)商會(hui)(hui)兼(jian)(jian)(jian)職(zhi)(zhi),個別確屬工(gong)作特殊需要兼(jian)(jian)(jian)職(zhi)(zhi)的(de),應當按照干部管(guan)理權限審批;退(tui)(tui)(離)休(xiu)三年(nian)后到(dao)行(xing)業協會(hui)(hui)商會(hui)(hui)兼(jian)(jian)(jian)職(zhi)(zhi),須按干部管(guan)理權限審批或備(bei)案(an)后方(fang)可兼(jian)(jian)(jian)職(zhi)(zhi)。

  對(dui)已在(zai)(zai)行(xing)業(ye)協(xie)(xie)會(hui)商會(hui)中任(ren)職、兼職的(de)(de)公(gong)務(wu)(wu)員,按相(xiang)關(guan)規定(ding)進行(xing)一次性清理。任(ren)職的(de)(de)在(zai)(zai)職公(gong)務(wu)(wu)員,脫(tuo)鉤后自愿選擇去留(liu)(liu):退(tui)出(chu)(chu)行(xing)業(ye)協(xie)(xie)會(hui)商會(hui)工(gong)(gong)作(zuo)的(de)(de),由所屬(shu)行(xing)政機關(guan)妥善(shan)安置;本人自愿繼續留(liu)(liu)在(zai)(zai)行(xing)業(ye)協(xie)(xie)會(hui)商會(hui)工(gong)(gong)作(zuo)的(de)(de),退(tui)出(chu)(chu)公(gong)務(wu)(wu)員管理,不再保留(liu)(liu)公(gong)務(wu)(wu)員身份。在(zai)(zai)行(xing)業(ye)協(xie)(xie)會(hui)商會(hui)兼職的(de)(de)公(gong)務(wu)(wu)員,要限期(qi)辭去兼任(ren)職務(wu)(wu)。

  行業協(xie)會(hui)(hui)(hui)商會(hui)(hui)(hui)全面實行勞動(dong)合同(tong)制度,與(yu)工(gong)作人員(yuan)(yuan)(yuan)簽(qian)訂(ding)勞動(dong)合同(tong),依法保障(zhang)工(gong)作人員(yuan)(yuan)(yuan)合法權益。工(gong)作人員(yuan)(yuan)(yuan)的工(gong)資,由行業協(xie)會(hui)(hui)(hui)商會(hui)(hui)(hui)按(an)照國家有關法律、法規和政(zheng)策確定。行業協(xie)會(hui)(hui)(hui)商會(hui)(hui)(hui)及其工(gong)作人員(yuan)(yuan)(yuan)按(an)規定參(can)加基(ji)本養老、基(ji)本醫療(liao)等社會(hui)(hui)(hui)保險和繳(jiao)存住房公積金(jin)。

  行(xing)(xing)業協(xie)會商會與行(xing)(xing)政(zheng)機關脫鉤后,使用的事(shi)(shi)業編制相應核(he)銷(xiao)。現有(you)事(shi)(shi)業人員按國家(jia)有(you)關規定參加機關事(shi)(shi)業單位養老保險。歷(li)次政(zheng)府(fu)機構改革(ge)分流人員仍執行(xing)(xing)原定政(zheng)策(ce)。

  (五)黨建、外事等事項分離,規范管(guan)理關系

  行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)商會(hui)(hui)的(de)黨(dang)(dang)(dang)(dang)建(jian)、外事、人(ren)力資源(yuan)服務(wu)等事項(xiang)與原(yuan)主(zhu)辦、主(zhu)管(guan)、聯系和(he)掛(gua)靠單(dan)(dan)(dan)位(wei)脫(tuo)鉤。全國(guo)(guo)性行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)商會(hui)(hui)與行(xing)(xing)(xing)政(zheng)(zheng)(zheng)機(ji)關(guan)脫(tuo)鉤后(hou)(hou)的(de)黨(dang)(dang)(dang)(dang)建(jian)工(gong)作(zuo),按照原(yuan)業(ye)務(wu)主(zhu)管(guan)單(dan)(dan)(dan)位(wei)黨(dang)(dang)(dang)(dang)的(de)關(guan)系歸(gui)口分別由(you)中央直(zhi)屬機(ji)關(guan)工(gong)委、中央國(guo)(guo)家機(ji)關(guan)工(gong)委、國(guo)(guo)務(wu)院國(guo)(guo)資委黨(dang)(dang)(dang)(dang)委領導。地(di)方行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)商會(hui)(hui)與行(xing)(xing)(xing)政(zheng)(zheng)(zheng)機(ji)關(guan)脫(tuo)鉤后(hou)(hou)的(de)黨(dang)(dang)(dang)(dang)建(jian)工(gong)作(zuo),依托各地(di)黨(dang)(dang)(dang)(dang)委組織部(bu)(bu)(bu)門(men)和(he)民(min)政(zheng)(zheng)(zheng)部(bu)(bu)(bu)門(men)建(jian)立社會(hui)(hui)組織黨(dang)(dang)(dang)(dang)建(jian)工(gong)作(zuo)機(ji)構(gou)統(tong)一(yi)(yi)領導;已經(jing)建(jian)立非公(gong)有(you)制(zhi)企業(ye)黨(dang)(dang)(dang)(dang)建(jian)工(gong)作(zuo)機(ji)構(gou)的(de),可依托組織部(bu)(bu)(bu)門(men)將(jiang)其與社會(hui)(hui)組織黨(dang)(dang)(dang)(dang)建(jian)工(gong)作(zuo)機(ji)構(gou)整合為(wei)一(yi)(yi)個機(ji)構(gou)。行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)商會(hui)(hui)脫(tuo)鉤后(hou)(hou),外事工(gong)作(zuo)由(you)住所地(di)省(區、市)人(ren)民(min)政(zheng)(zheng)(zheng)府按中央有(you)關(guan)外事管(guan)理(li)規定執(zhi)行(xing)(xing)(xing),不再經(jing)原(yuan)主(zhu)辦、主(zhu)管(guan)、聯系和(he)掛(gua)靠單(dan)(dan)(dan)位(wei)審批。行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)商會(hui)(hui)主(zhu)管(guan)和(he)主(zhu)辦的(de)新聞出(chu)版(ban)單(dan)(dan)(dan)位(wei)的(de)業(ye)務(wu)管(guan)理(li),按照文化(hua)體(ti)制(zhi)改革相關(guan)要求和(he)新聞出(chu)版(ban)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)管(guan)理(li)部(bu)(bu)(bu)門(men)有(you)關(guan)規定執(zhi)行(xing)(xing)(xing)。人(ren)力資源(yuan)服務(wu)等事項(xiang)由(you)行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)商會(hui)(hui)住所地(di)有(you)關(guan)部(bu)(bu)(bu)門(men)按職能(neng)分工(gong)承擔。

  四、配套政策

  (一)完善(shan)支持政策(ce)

  制定有針(zhen)對性的(de)扶持(chi)(chi)引導(dao)政策,加強分(fen)類(lei)指(zhi)導(dao)。完善政府購買服(fu)務機制,支持(chi)(chi)行(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)轉(zhuan)型發展。鼓勵各有關(guan)部門(men)按照(zhao)《國(guo)務院辦(ban)公廳關(guan)于(yu)政府向社(she)會(hui)(hui)力量(liang)購買服(fu)務的(de)指(zhi)導(dao)意見》要求,向符合條(tiao)件的(de)行(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)和其他社(she)會(hui)(hui)力量(liang)購買服(fu)務,及時(shi)公布購買服(fu)務事項和相關(guan)信息,加強績效管理。

  完善(shan)行(xing)業協會(hui)商會(hui)價(jia)格政策,落(luo)實(shi)(shi)有(you)關(guan)稅收(shou)(shou)政策。按照行(xing)政事(shi)業性收(shou)(shou)費管理的(de)有(you)關(guan)規定(ding),規范行(xing)業協會(hui)商會(hui)承接政府委托的(de)行(xing)政事(shi)業性收(shou)(shou)費事(shi)項(xiang)。對(dui)符合條(tiao)件(jian)的(de)非(fei)營利組織落(luo)實(shi)(shi)企業所得稅優惠政策。

  鼓勵(li)行業(ye)協(xie)(xie)會(hui)商會(hui)參與制(zhi)(zhi)定(ding)(ding)相關立法、政府規(gui)劃、公共政策、行業(ye)標(biao)準和行業(ye)數據統計等(deng)事務(wu)。有關部門要充分(fen)發揮(hui)行業(ye)協(xie)(xie)會(hui)商會(hui)在行業(ye)指南制(zhi)(zhi)定(ding)(ding)、行業(ye)人才培(pei)養、共性技(ji)術平(ping)臺建設、第三方咨詢(xun)評(ping)估等(deng)方面作用,完(wan)善(shan)對行業(ye)協(xie)(xie)會(hui)商會(hui)服(fu)務(wu)創新能力建設的支持機制(zhi)(zhi)。

  建立信(xin)(xin)息(xi)資源共(gong)享機制(zhi)。全(quan)國性行業(ye)協會(hui)商(shang)會(hui)的有關(guan)行業(ye)統計數(shu)據(ju)(ju),按(an)原規(gui)定(ding)報送(song)國家(jia)統計局。行業(ye)協會(hui)商(shang)會(hui)應按(an)原渠(qu)道向行業(ye)管理部(bu)門報送(song)相關(guan)行業(ye)數(shu)據(ju)(ju)和信(xin)(xin)息(xi)。有關(guan)職能部(bu)門要(yao)建立行業(ye)公共(gong)信(xin)(xin)息(xi)交(jiao)匯平(ping)臺,整合全(quan)國性行業(ye)協會(hui)商(shang)會(hui)的有關(guan)數(shu)據(ju)(ju),為政府制(zhi)定(ding)和實施相關(guan)政策提(ti)供信(xin)(xin)息(xi)服務,為行業(ye)協會(hui)商(shang)會(hui)提(ti)供必要(yao)的行業(ye)信(xin)(xin)息(xi)和數(shu)據(ju)(ju)。

  支持(chi)行業協(xie)會(hui)(hui)商會(hui)(hui)在進(jin)出口貿易和對(dui)外(wai)經(jing)濟(ji)交流、企業“走出去(qu)”、應(ying)對(dui)貿易摩擦等(deng)事務中,發(fa)揮協(xie)調、指導、咨詢、服務作用。鼓勵行業協(xie)會(hui)(hui)商會(hui)(hui)參與(yu)協(xie)助(zhu)政府部(bu)門多雙邊經(jing)貿談判工作,提供相關咨詢和協(xie)調服務。鼓勵行業協(xie)會(hui)(hui)商會(hui)(hui)積極搭建促(cu)進(jin)對(dui)外(wai)貿易和投資等(deng)服務平臺,幫助(zhu)企業開拓國際市場(chang)。

  (二)完善綜(zong)合監管體(ti)制

  加(jia)(jia)強(qiang)法(fa)律法(fa)規制度建設。加(jia)(jia)快推(tui)進(jin)行(xing)業(ye)(ye)(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)立(li)法(fa)工作。行(xing)業(ye)(ye)(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)脫鉤后,按程(cheng)序(xu)修改章程(cheng)并(bing)報民政部門備案(an)。健全行(xing)業(ye)(ye)(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)退出機制,在實施脫鉤中對職(zhi)能不清(qing)、業(ye)(ye)(ye)(ye)務開展(zhan)不正常、不適應(ying)經濟(ji)社會(hui)(hui)(hui)發展(zhan)的行(xing)業(ye)(ye)(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)依法(fa)予以注銷。鼓(gu)勵和促進(jin)行(xing)業(ye)(ye)(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)會(hui)(hui)(hui)間公(gong)平有序(xu)競爭。

  完善信(xin)用體(ti)系和信(xin)息公(gong)(gong)開(kai)(kai)制(zhi)(zhi)(zhi)度(du)。建立行業(ye)協會(hui)(hui)商(shang)會(hui)(hui)信(xin)用承諾制(zhi)(zhi)(zhi)度(du),完善行業(ye)協會(hui)(hui)商(shang)會(hui)(hui)的(de)(de)信(xin)用記(ji)錄,建立綜合信(xin)用評級制(zhi)(zhi)(zhi)度(du)。對行業(ye)協會(hui)(hui)商(shang)會(hui)(hui)的(de)(de)信(xin)用情(qing)況開(kai)(kai)展(zhan)社會(hui)(hui)評價(jia),評價(jia)結果(guo)向社會(hui)(hui)公(gong)(gong)布。建立健全行業(ye)協會(hui)(hui)商(shang)會(hui)(hui)信(xin)息公(gong)(gong)開(kai)(kai)和年(nian)度(du)報告制(zhi)(zhi)(zhi)度(du),接受社會(hui)(hui)監督。

  建(jian)立(li)(li)完(wan)善法人(ren)治(zhi)理結(jie)(jie)構。行(xing)(xing)業協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)要按(an)照建(jian)立(li)(li)現代(dai)社會(hui)(hui)(hui)組(zu)織要求,建(jian)立(li)(li)和(he)(he)完(wan)善產權清晰、權責(ze)(ze)明確、運轉協調(diao)、制(zhi)(zhi)衡(heng)有效的(de)法人(ren)治(zhi)理結(jie)(jie)構。健全(quan)行(xing)(xing)業協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)章(zhang)程審核(he)備(bei)案機制(zhi)(zhi),完(wan)善以(yi)章(zhang)程為核(he)心的(de)內部管(guan)理制(zhi)(zhi)度(du),健全(quan)會(hui)(hui)(hui)員(yuan)大會(hui)(hui)(hui)(會(hui)(hui)(hui)員(yuan)代(dai)表大會(hui)(hui)(hui))、理事(shi)(shi)(shi)(shi)(shi)會(hui)(hui)(hui)(常務理事(shi)(shi)(shi)(shi)(shi)會(hui)(hui)(hui))制(zhi)(zhi)度(du),建(jian)立(li)(li)和(he)(he)健全(quan)監(jian)事(shi)(shi)(shi)(shi)(shi)會(hui)(hui)(hui)(監(jian)事(shi)(shi)(shi)(shi)(shi))制(zhi)(zhi)度(du)。落(luo)實民(min)主選(xuan)(xuan)舉、差額選(xuan)(xuan)舉和(he)(he)無記名投(tou)票制(zhi)(zhi)度(du)。鼓勵選(xuan)(xuan)舉企業家擔任(ren)行(xing)(xing)業協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)理事(shi)(shi)(shi)(shi)(shi)長(chang)(chang),探索實行(xing)(xing)理事(shi)(shi)(shi)(shi)(shi)長(chang)(chang)(會(hui)(hui)(hui)長(chang)(chang))輪(lun)值(zhi)制(zhi)(zhi),推(tui)行(xing)(xing)秘(mi)書長(chang)(chang)聘(pin)任(ren)制(zhi)(zhi)。實施法定代(dai)表人(ren)述職、主要負責(ze)(ze)人(ren)任(ren)職前公示和(he)(he)過錯責(ze)(ze)任(ren)追究制(zhi)(zhi)度(du)。在重要的(de)行(xing)(xing)業協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)試行(xing)(xing)委派(pai)監(jian)事(shi)(shi)(shi)(shi)(shi)制(zhi)(zhi)度(du),委派(pai)監(jian)事(shi)(shi)(shi)(shi)(shi)履(lv)行(xing)(xing)監(jian)督和(he)(he)指導職責(ze)(ze),督促行(xing)(xing)業協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)落(luo)實宏觀調(diao)控政策(ce)和(he)(he)行(xing)(xing)業政策(ce)。所派(pai)監(jian)事(shi)(shi)(shi)(shi)(shi)不在行(xing)(xing)業協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)兼職、取(qu)酬、享(xiang)受(shou)福利(li)。

  五、組織實施

  (一)建(jian)立工作機制

  國(guo)家(jia)發展(zhan)改革委(wei)、民政(zheng)部(bu)會(hui)同(tong)中(zhong)(zhong)央組織部(bu)、中(zhong)(zhong)央編辦、中(zhong)(zhong)央直屬機(ji)關(guan)工(gong)委(wei)、中(zhong)(zhong)央國(guo)家(jia)機(ji)關(guan)工(gong)委(wei)、外交部(bu)、工(gong)業(ye)和信息化部(bu)、財政(zheng)部(bu)、人(ren)力資源社會(hui)保障部(bu)、商(shang)務(wu)部(bu)、審(shen)計(ji)署、國(guo)務(wu)院(yuan)國(guo)資委(wei)、國(guo)管局、全(quan)國(guo)工(gong)商(shang)聯(lian),成(cheng)立行(xing)業(ye)協會(hui)商(shang)會(hui)與(yu)行(xing)政(zheng)機(ji)關(guan)脫鉤聯(lian)合工(gong)作(zuo)(zuo)(zuo)組(以(yi)下簡稱聯(lian)合工(gong)作(zuo)(zuo)(zuo)組),負責組織實(shi)施本(ben)(ben)方案,推進全(quan)國(guo)性行(xing)業(ye)協會(hui)商(shang)會(hui)脫鉤工(gong)作(zuo)(zuo)(zuo),指導和督(du)促各(ge)地(di)(di)開展(zhan)脫鉤工(gong)作(zuo)(zuo)(zuo)。聯(lian)合工(gong)作(zuo)(zuo)(zuo)組由(you)國(guo)務(wu)院(yuan)領(ling)導同(tong)志(zhi)牽頭,辦公室(shi)設在國(guo)家(jia)發展(zhan)改革委(wei)。各(ge)地(di)(di)建立相(xiang)應領(ling)導機(ji)制(zhi)和工(gong)作(zuo)(zuo)(zuo)組,制(zhi)定本(ben)(ben)地(di)(di)區脫鉤方案,負責推進本(ben)(ben)地(di)(di)區脫鉤工(gong)作(zuo)(zuo)(zuo)。

  (二)明確責(ze)任分工(gong)

  各(ge)相(xiang)關(guan)職(zhi)能部(bu)門(men)按照本方(fang)案和職(zhi)能分(fen)工(gong),落(luo)實(shi)相(xiang)關(guan)政策(ce)和措施。各(ge)級發(fa)展(zhan)改革、民政部(bu)門(men)負(fu)(fu)責統籌協調、督(du)促檢查(cha)(cha)脫鉤(gou)工(gong)作。審計部(bu)門(men)負(fu)(fu)責對(dui)資產清查(cha)(cha)結(jie)果進行抽查(cha)(cha)監督(du),審計脫鉤(gou)過程(cheng)中財政資金使用情況。各(ge)業務主管單位負(fu)(fu)責逐個制定(ding)行業協會商會脫鉤(gou)實(shi)施方(fang)案,落(luo)實(shi)各(ge)項工(gong)作,并向社會公開。

  為適應(ying)行(xing)業協會(hui)商會(hui)脫(tuo)鉤(gou)后的新體制新要求,國家發展(zhan)改革委、民政部(bu)會(hui)同有關(guan)部(bu)門(men)制定綜(zong)合監管辦法。

  (三)穩(wen)妥開展試(shi)點

  全國性行(xing)(xing)業(ye)協(xie)會(hui)商(shang)(shang)會(hui)脫鉤試(shi)(shi)點(dian)工作由民(min)政部牽頭負責,2015年(nian)下半年(nian)開始第(di)一批(pi)試(shi)(shi)點(dian),2016年(nian)總結(jie)經(jing)(jing)驗(yan)、擴大(da)試(shi)(shi)點(dian),2017年(nian)在(zai)更(geng)大(da)范圍試(shi)(shi)點(dian),通過(guo)試(shi)(shi)點(dian)完善相應的體制機(ji)制后全面(mian)推(tui)開。按照兼顧不同類型、行(xing)(xing)業(ye)和部門的原(yuan)則,第(di)一批(pi)選擇100個左右全國性行(xing)(xing)業(ye)協(xie)會(hui)商(shang)(shang)會(hui)開展脫鉤試(shi)(shi)點(dian)。各(ge)業(ye)務主管單(dan)位于2015年(nian)7月(yue)底前將推(tui)薦試(shi)(shi)點(dian)名單(dan)報(bao)送民(min)政部,并逐個制定試(shi)(shi)點(dian)行(xing)(xing)業(ye)協(xie)會(hui)商(shang)(shang)會(hui)脫鉤實(shi)施方(fang)案(an)。方(fang)案(an)報(bao)經(jing)(jing)民(min)政部核準、聯合(he)工作組批(pi)復(fu)后實(shi)施,其中須有(you)關部門批(pi)準的事項,按管理權限和職能分別報(bao)批(pi)。各(ge)試(shi)(shi)點(dian)單(dan)位要在(zai)2016年(nian)6月(yue)底前完成第(di)一批(pi)試(shi)(shi)點(dian),由聯合(he)工作組對試(shi)(shi)點(dian)成效(xiao)進行(xing)(xing)評估并認真總結(jie)經(jing)(jing)驗(yan),完善配套政策。

  地(di)方行業協會(hui)商會(hui)脫(tuo)鉤試(shi)(shi)點(dian)工作(zuo)(zuo)由(you)各省(區、市)工作(zuo)(zuo)組負責。各省(區、市)同步開(kai)(kai)展本地(di)區脫(tuo)鉤試(shi)(shi)點(dian)工作(zuo)(zuo),首先選擇幾個省一(yi)級協會(hui)開(kai)(kai)展試(shi)(shi)點(dian),試(shi)(shi)點(dian)方案報經(jing)民政部核準(zhun)、聯(lian)合(he)工作(zuo)(zuo)組批復后實施。各地(di)要在(zai)2016年底前完(wan)成第一(yi)批試(shi)(shi)點(dian)和(he)評(ping)估,并將評(ping)估結果報聯(lian)合(he)工作(zuo)(zuo)組。在(zai)認真總結經(jing)驗的(de)基礎上(shang),完(wan)善試(shi)(shi)點(dian)政策,逐步擴大試(shi)(shi)點(dian)范圍,穩妥(tuo)審慎推開(kai)(kai)。

  (四)精心組織實施(shi)

  脫鉤(gou)工(gong)(gong)(gong)作(zuo)涉及(ji)面廣、政(zheng)策性強、社(she)會(hui)(hui)關注度(du)高,各地區、各有關部門和(he)行(xing)業協會(hui)(hui)商會(hui)(hui)要高度(du)重(zhong)視,嚴明紀律,做好(hao)風險預案,確保(bao)如(ru)期完成脫鉤(gou)任務。要嚴格(ge)按照本(ben)方案要求推進脫鉤(gou)工(gong)(gong)(gong)作(zuo),規范工(gong)(gong)(gong)作(zuo)程(cheng)序,建立考核機(ji)制(zhi),確保(bao)工(gong)(gong)(gong)作(zuo)有序開展(zhan)。要加強輿(yu)論引導和(he)政(zheng)策解讀,形成良(liang)好(hao)輿(yu)論氛(fen)圍。脫鉤(gou)工(gong)(gong)(gong)作(zuo)中遇有重(zhong)要情況和(he)問(wen)題,要及(ji)時向聯合工(gong)(gong)(gong)作(zuo)組(zu)報告。

  各地區、各部門(men)要大力(li)支(zhi)持行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)發展(zhan),優(you)化(hua)發展(zhan)環境,改(gai)進工作方式,構建與行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)新型合作關系;建立(li)和完善(shan)與行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)協(xie)(xie)(xie)(xie)商(shang)機(ji)制,在(zai)研究重大問(wen)題(ti)和制定(ding)相關法律(lv)法規(gui)(gui)、規(gui)(gui)劃、政策時(shi)應主(zhu)動聽取相關行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)意(yi)見;加強(qiang)對行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)的(de)指導(dao)(dao)和支(zhi)持,及(ji)時(shi)研究解(jie)決行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)改(gai)革(ge)發展(zhan)中的(de)困難(nan)和問(wen)題(ti)。行(xing)(xing)(xing)業(ye)協(xie)(xie)(xie)(xie)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)要加快轉(zhuan)型,努力(li)適(shi)應新常態、新規(gui)(gui)則、新要求,完善(shan)治理結構,規(gui)(gui)范(fan)自(zi)身行(xing)(xing)(xing)為,提升專業(ye)服務水平,強(qiang)化(hua)行(xing)(xing)(xing)業(ye)自(zi)律(lv),引導(dao)(dao)企業(ye)規(gui)(gui)范(fan)經營(ying),積極反映會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)員(yuan)(yuan)訴求,維(wei)護會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)員(yuan)(yuan)合法權益(yi),真正成為依法自(zi)治的(de)現代社會(hui)(hui)(hui)(hui)(hui)(hui)(hui)(hui)組織。

  自本方案印發之日起,新(xin)設立的行業協(xie)會(hui)商會(hui),按(an)本方案要(yao)求(qiu)執行。
