  2016年推進簡(jian)政(zheng)放權(quan)放管(guan)結合優化(hua)服務改革工作要點

  2016年(nian)(nian)是“十三五”規劃開局之年(nian)(nian),也(ye)是推進(jin)供給側(ce)結構性(xing)改(gai)革(ge)的攻堅之年(nian)(nian)。今年(nian)(nian)推進(jin)簡(jian)政放權、放管結合(he)、優(you)(you)化服(fu)(fu)務(wu)改(gai)革(ge)的總體要求(qiu)是:全面貫徹黨的十八(ba)大(da)和十八(ba)屆二中(zhong)(zhong)、三中(zhong)(zhong)、四中(zhong)(zhong)、五中(zhong)(zhong)全會(hui)精神,認(ren)真落實中(zhong)(zhong)央經(jing)濟工作(zuo)會(hui)議和《政府工作(zuo)報(bao)告》部署,按(an)照創新(xin)、協調、綠色、開放、共享(xiang)的發展理念,緊(jin)緊(jin)扭住(zhu)轉變政府職(zhi)能這(zhe)個“牛鼻子(zi)”,在更大(da)范圍、更深層次,以更有力舉(ju)措(cuo)推進(jin)簡(jian)政放權、放管結合(he)、優(you)(you)化服(fu)(fu)務(wu)改(gai)革(ge),使市場在資(zi)源配置中(zhong)(zhong)起(qi)決定性(xing)作(zuo)用和更好發揮政府作(zuo)用,破除制(zhi)約企業和群眾(zhong)(zhong)辦(ban)事創業的體制(zhi)機制(zhi)障礙,著(zhu)力降低制(zhi)度性(xing)交(jiao)易成本,優(you)(you)化營商環境,激發市場活力和社會(hui)創造力,與大(da)眾(zhong)(zhong)創業、萬眾(zhong)(zhong)創新(xin)和發展壯大(da)新(xin)經(jing)濟緊(jin)密結合(he)起(qi)來(lai),進(jin)一(yi)步形成經(jing)濟增長內生動力,促(cu)進(jin)經(jing)濟社會(hui)持續健康發展。

  一、持續簡政放權(quan),進一步激(ji)發市場(chang)活力和社會創造力

  (一(yi)(yi))繼續(xu)深化行(xing)(xing)(xing)政(zheng)(zheng)(zheng)審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)改革。繼續(xu)加(jia)大放(fang)(fang)(fang)權(quan)力度,把該放(fang)(fang)(fang)的(de)(de)權(quan)力放(fang)(fang)(fang)出去(qu),能取(qu)消的(de)(de)要(yao)(yao)(yao)(yao)(yao)盡量取(qu)消,直(zhi)接放(fang)(fang)(fang)給(gei)市(shi)場和社會。今(jin)年要(yao)(yao)(yao)(yao)(yao)再取(qu)消50項(xiang)(xiang)以(yi)上國(guo)務(wu)(wu)院部門(men)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)和中央指(zhi)定地方(fang)(fang)實施的(de)(de)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang),再取(qu)消一(yi)(yi)批(pi)(pi)(pi)(pi)(pi)(pi)國(guo)務(wu)(wu)院部門(men)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)中介(jie)服務(wu)(wu)事(shi)項(xiang)(xiang),削減一(yi)(yi)批(pi)(pi)(pi)(pi)(pi)(pi)生產(chan)許(xu)可(ke)(ke)證、經營許(xu)可(ke)(ke)證。對(dui)確需(xu)下放(fang)(fang)(fang)給(gei)基層(ceng)的(de)(de)審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang),要(yao)(yao)(yao)(yao)(yao)在人才、經費、技術(shu)、裝備等方(fang)(fang)面予以(yi)保障,確保基層(ceng)接得住、管(guan)得好。對(dui)相(xiang)同、相(xiang)近或相(xiang)關(guan)聯的(de)(de)審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang),要(yao)(yao)(yao)(yao)(yao)一(yi)(yi)并取(qu)消或下放(fang)(fang)(fang),提高放(fang)(fang)(fang)權(quan)的(de)(de)協同性、聯動性。對(dui)確需(xu)保留的(de)(de)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang),要(yao)(yao)(yao)(yao)(yao)統一(yi)(yi)審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)標準,簡化審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)手續(xu),規范審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)流程。所有行(xing)(xing)(xing)政(zheng)(zheng)(zheng)審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)都要(yao)(yao)(yao)(yao)(yao)嚴格(ge)按法定時限做到“零超時”。繼續(xu)開展相(xiang)對(dui)集中行(xing)(xing)(xing)政(zheng)(zheng)(zheng)許(xu)可(ke)(ke)權(quan)改革試(shi)點,推(tui)廣地方(fang)(fang)實施綜(zong)合審(shen)(shen)批(pi)(pi)(pi)(pi)(pi)(pi)的(de)(de)經驗(yan)。(國(guo)務(wu)(wu)院審(shen)(shen)改辦牽頭,國(guo)務(wu)(wu)院各有關(guan)部門(men)按職(zhi)責分工負責)

  (二)深入(ru)(ru)推進投(tou)(tou)資(zi)(zi)審(shen)(shen)批(pi)改革(ge)。進一步擴(kuo)大(da)企業(ye)自(zi)主權,再(zai)修訂政府核(he)準的投(tou)(tou)資(zi)(zi)項(xiang)目(mu)(mu)目(mu)(mu)錄,中央政府層面核(he)準的企業(ye)投(tou)(tou)資(zi)(zi)項(xiang)目(mu)(mu)削減比例累計達到原總量的90%以(yi)上。出(chu)臺《企業(ye)投(tou)(tou)資(zi)(zi)項(xiang)目(mu)(mu)核(he)準和備案(an)管(guan)理條例》。制(zhi)定中央預算內投(tou)(tou)資(zi)(zi)審(shen)(shen)批(pi)制(zhi)度改革(ge)方案(an)。出(chu)臺整(zheng)合規范投(tou)(tou)資(zi)(zi)建設項(xiang)目(mu)(mu)報建審(shen)(shen)批(pi)事項(xiang)實施(shi)方案(an)。保留的投(tou)(tou)資(zi)(zi)項(xiang)目(mu)(mu)審(shen)(shen)批(pi)事項(xiang)要全部(bu)納入(ru)(ru)全國統一的投(tou)(tou)資(zi)(zi)項(xiang)目(mu)(mu)在線(xian)審(shen)(shen)批(pi)監管(guan)平臺,實行(xing)“一站式(shi)”網(wang)上審(shen)(shen)批(pi),大(da)幅縮短審(shen)(shen)批(pi)流(liu)程(cheng)和審(shen)(shen)批(pi)時間,推進投(tou)(tou)資(zi)(zi)審(shen)(shen)批(pi)提速。(國家發展改革(ge)委(wei)牽頭,國土資(zi)(zi)源部(bu)、環境保護(hu)部(bu)、住房城鄉建設部(bu)、交(jiao)通運輸部(bu)、水利部(bu)、國務院法制(zhi)辦等相關部(bu)門按職責分工(gong)負(fu)責)

  (三)扎實(shi)做好職(zhi)業資(zi)格(ge)(ge)改革。再取消(xiao)一(yi)批(pi)職(zhi)業資(zi)格(ge)(ge)許(xu)可(ke)和認(ren)定事項,國(guo)務(wu)院(yuan)部門設置的(de)(de)職(zhi)業資(zi)格(ge)(ge)削(xue)減比例達(da)到(dao)原總量的(de)(de)70%以上。全面清理(li)名目繁多的(de)(de)各種行業準(zhun)入(ru)證、上崗證等,不合(he)理(li)的(de)(de)要堅決取消(xiao)或(huo)整(zheng)合(he)。建立(li)國(guo)家職(zhi)業資(zi)格(ge)(ge)目錄清單(dan)管(guan)理(li)制度,清單(dan)之外一(yi)律(lv)不得開展(zhan)職(zhi)業資(zi)格(ge)(ge)許(xu)可(ke)和認(ren)定工(gong)作,清單(dan)之內(nei)除準(zhun)入(ru)類(lei)職(zhi)業資(zi)格(ge)(ge)外一(yi)律(lv)不得與就業創(chuang)業掛(gua)鉤。嚴肅(su)查(cha)處(chu)職(zhi)業資(zi)格(ge)(ge)“掛(gua)證”、“助考(kao)”等行為,嚴格(ge)(ge)落實(shi)考(kao)培分離(li)。(人力(li)資(zi)源社會(hui)保(bao)障(zhang)部牽頭,工(gong)業和信息化部、住房(fang)城(cheng)鄉建設部、交通運(yun)輸部、國(guo)務(wu)院(yuan)國(guo)資(zi)委、質(zhi)檢總局、安(an)全監(jian)(jian)管(guan)總局、食品(pin)(pin)藥品(pin)(pin)監(jian)(jian)管(guan)總局等相關(guan)部門按職(zhi)責分工(gong)負(fu)責)

  (四)持續(xu)推(tui)進(jin)商(shang)事(shi)制度改革(ge)。進(jin)一(yi)步放(fang)寬市場準(zhun)(zhun)入,繼(ji)續(xu)大力削減(jian)工(gong)(gong)商(shang)登(deng)(deng)記前置(zhi)審(shen)批事(shi)項,今年再取消三分之(zhi)一(yi),削減(jian)比例達到原總量的(de)90%以上(shang)(shang),同(tong)步取消后置(zhi)審(shen)批事(shi)項50項以上(shang)(shang)。在全面實施企業(ye)“三證合(he)一(yi)”基礎上(shang)(shang),再整(zheng)合(he)社會(hui)保險(xian)登(deng)(deng)記證和統計登(deng)(deng)記證,實現“五證合(he)一(yi)、一(yi)照一(yi)碼”,降低(di)創業(ye)準(zhun)(zhun)入的(de)制度成(cheng)本。擴大“三證合(he)一(yi)”覆蓋面,推(tui)進(jin)整(zheng)合(he)個體工(gong)(gong)商(shang)戶營業(ye)執照和稅務(wu)(wu)登(deng)(deng)記證,實現只需(xu)填寫(xie)“一(yi)張表”、向“一(yi)個窗口”提交“一(yi)套材(cai)料”,即可辦理(li)工(gong)(gong)商(shang)及稅務(wu)(wu)登(deng)(deng)記。加快(kuai)推(tui)進(jin)工(gong)(gong)商(shang)登(deng)(deng)記全程電子化、名稱登(deng)(deng)記、放(fang)寬住所條(tiao)件(jian)、簡易注銷登(deng)(deng)記等改革(ge)試點。加快(kuai)推(tui)行電子營業(ye)執照。抓(zhua)好“證照分離”改革(ge)試點,切實減(jian)少(shao)各種(zhong)不(bu)必要(yao)的(de)證,解決企業(ye)“準(zhun)(zhun)入不(bu)準(zhun)(zhun)營”的(de)問(wen)題(ti),盡快(kuai)總結形(xing)成(cheng)可復制、可推(tui)廣的(de)經驗。(工(gong)(gong)商(shang)總局(ju)、國(guo)務(wu)(wu)院審(shen)改辦牽頭,人力資源社會(hui)保障部、稅務(wu)(wu)總局(ju)、國(guo)務(wu)(wu)院法(fa)制辦、國(guo)家統計局(ju)等相關部門和上(shang)(shang)海(hai)市人民政府按(an)職責(ze)分工(gong)(gong)負責(ze))

  (五)積極開(kai)展收(shou)費清理改革和監督檢查。嚴格落(luo)實已出臺的各項收費清理政(zheng)策,防止反(fan)彈或變相收費。全面清理和整合規(gui)范各(ge)類認(ren)證、評估、檢(jian)查、檢(jian)測等中介服務,有效解決評審(shen)評估事項多、耗時長、費用高等問題。重(zhong)點整治各(ge)種涉企(qi)亂收(shou)費,完(wan)善涉企(qi)收(shou)費監督檢(jian)查制度,強(qiang)化舉報(bao)、查處和問責機制。組織對(dui)涉企(qi)收(shou)費專項監督檢(jian)查,切實(shi)減(jian)輕(qing)企(qi)業負(fu)擔。(財政部、國家發展(zhan)改革委、工業和信息化部牽頭,民政部、質檢總局等相關部門按職責分工負責)

  (六(liu))擴(kuo)大高(gao)(gao)校和(he)科(ke)(ke)(ke)研(yan)院(yuan)(yuan)(yuan)所自主權(quan)(quan)。凡(fan)是束縛教學(xue)科(ke)(ke)(ke)研(yan)人(ren)員(yuan)積極(ji)性創造性發揮的不合理規定,都要取消(xiao)或修改;凡(fan)是高(gao)(gao)校和(he)科(ke)(ke)(ke)研(yan)院(yuan)(yuan)(yuan)所能夠(gou)自主管理的事項,相關權(quan)(quan)限都要下放,特別是要擴(kuo)大高(gao)(gao)校和(he)科(ke)(ke)(ke)研(yan)院(yuan)(yuan)(yuan)所在經費使用(yong)、成果(guo)處(chu)置(zhi)、職稱評審、選人(ren)用(yong)人(ren)、薪酬(chou)分配(pei)、設備(bei)采購、學(xue)科(ke)(ke)(ke)專業設置(zhi)等方面的自主權(quan)(quan)。落實(shi)完善支持教學(xue)科(ke)(ke)(ke)研(yan)人(ren)員(yuan)創業創新的股權(quan)(quan)期權(quan)(quan)激勵等相關政策,促進(jin)科(ke)(ke)(ke)技成果(guo)轉(zhuan)化。為教學(xue)科(ke)(ke)(ke)研(yan)人(ren)員(yuan)從事兼職創業積極(ji)創造寬松條(tiao)件。(教育部(bu)、科(ke)(ke)(ke)技部(bu)牽頭,國(guo)務(wu)院(yuan)(yuan)(yuan)審改辦、財(cai)政部(bu)、人(ren)力(li)資源社(she)會保障部(bu)、海關總(zong)署、工(gong)商總(zong)局(ju)(ju)、稅務(wu)總(zong)局(ju)(ju)、國(guo)家知識產權(quan)(quan)局(ju)(ju)、中(zhong)(zhong)國(guo)科(ke)(ke)(ke)學(xue)院(yuan)(yuan)(yuan)、中(zhong)(zhong)國(guo)社(she)科(ke)(ke)(ke)院(yuan)(yuan)(yuan)、中(zhong)(zhong)國(guo)工(gong)程院(yuan)(yuan)(yuan)等相關部(bu)門、單位按職責分工(gong)負責)

  (七)以政(zheng)務(wu)(wu)公(gong)(gong)(gong)(gong)開(kai)推動簡(jian)政(zheng)放(fang)權(quan)。以更大(da)力度(du)推進(jin)政(zheng)務(wu)(wu)公(gong)(gong)(gong)(gong)開(kai),讓人民群(qun)眾和(he)企業了解放(fang)權(quan)情況、監督放(fang)權(quan)進(jin)程(cheng)、評(ping)價放(fang)權(quan)效(xiao)果(guo),做到(dao)權(quan)力公(gong)(gong)(gong)(gong)開(kai)透明(ming)、群(qun)眾明(ming)白(bai)辦事(shi)。全(quan)(quan)面(mian)公(gong)(gong)(gong)(gong)布地(di)方各(ge)級政(zheng)府(fu)部(bu)(bu)門(men)(men)權(quan)力清(qing)(qing)(qing)單(dan)和(he)責任(ren)清(qing)(qing)(qing)單(dan)。抓(zhua)緊制(zhi)定國(guo)務(wu)(wu)院(yuan)試點部(bu)(bu)門(men)(men)權(quan)力清(qing)(qing)(qing)單(dan)和(he)責任(ren)清(qing)(qing)(qing)單(dan);在部(bu)(bu)分地(di)區(qu)試點市場準入負面(mian)清(qing)(qing)(qing)單(dan)制(zhi)度(du),進(jin)一步壓(ya)縮負面(mian)清(qing)(qing)(qing)單(dan);加(jia)快編制(zhi)行(xing)(xing)政(zheng)事(shi)業性(xing)收(shou)費、政(zheng)府(fu)定價或指導價經(jing)營服務(wu)(wu)性(xing)收(shou)費、政(zheng)府(fu)性(xing)基金、國(guo)家(jia)職業資格(ge)、基本公(gong)(gong)(gong)(gong)共(gong)服務(wu)(wu)事(shi)項等(deng)各(ge)方面(mian)清(qing)(qing)(qing)單(dan),并(bing)及時(shi)主(zhu)動向(xiang)社(she)(she)會(hui)公(gong)(gong)(gong)(gong)開(kai)。堅持“公(gong)(gong)(gong)(gong)開(kai)為(wei)常態,不公(gong)(gong)(gong)(gong)開(kai)為(wei)例外”,全(quan)(quan)面(mian)推進(jin)決策、執行(xing)(xing)、管理、服務(wu)(wu)、結果(guo)公(gong)(gong)(gong)(gong)開(kai)和(he)重(zhong)點領域信息公(gong)(gong)(gong)(gong)開(kai)。落實行(xing)(xing)政(zheng)許可(ke)、行(xing)(xing)政(zheng)處(chu)罰等(deng)信息自作(zuo)出行(xing)(xing)政(zheng)決定之日起7個(ge)工作(zuo)日內上網(wang)公(gong)(gong)(gong)(gong)開(kai)的要求。加(jia)大(da)政(zheng)府(fu)信息數據開(kai)放(fang)力度(du),除涉及國(guo)家(jia)安全(quan)(quan)、商業秘(mi)密(mi)、個(ge)人隱(yin)私的外,都應向(xiang)社(she)(she)會(hui)開(kai)放(fang)。及時(shi)公(gong)(gong)(gong)(gong)開(kai)突發(fa)(fa)敏感事(shi)件處(chu)置(zhi)信息,回應社(she)(she)會(hui)關切。(國(guo)務(wu)(wu)院(yuan)辦公(gong)(gong)(gong)(gong)廳(ting)牽頭,國(guo)務(wu)(wu)院(yuan)審(shen)改辦、國(guo)家(jia)發(fa)(fa)展改革(ge)委、教育部(bu)(bu)、公(gong)(gong)(gong)(gong)安部(bu)(bu)、民政(zheng)部(bu)(bu)、財(cai)政(zheng)部(bu)(bu)、人力資源社(she)(she)會(hui)保障部(bu)(bu)、住房城鄉建設部(bu)(bu)、商務(wu)(wu)部(bu)(bu)、國(guo)家(jia)衛(wei)生計(ji)生委、工商總局(ju)、國(guo)家(jia)統(tong)計(ji)局(ju)等(deng)相關部(bu)(bu)門(men)(men)按職責分工負責)

  二、加強監(jian)管創新(xin),促(cu)進社會(hui)公平正義

  (八)實施公(gong)正監(jian)(jian)管。推進(jin)政(zheng)府監(jian)(jian)管體制(zhi)改革(ge),加(jia)快構建(jian)事(shi)中(zhong)事(shi)后監(jian)(jian)管體系(xi)。全面推開“雙隨(sui)(sui)(sui)機(ji)(ji)(ji)(ji)、一(yi)(yi)公(gong)開”監(jian)(jian)管,抓緊建(jian)立隨(sui)(sui)(sui)機(ji)(ji)(ji)(ji)抽(chou)(chou)查(cha)事(shi)項清單(dan)(dan)、檢查(cha)對(dui)象名(ming)錄(lu)庫(ku)和執(zhi)法檢查(cha)人(ren)員名(ming)錄(lu)庫(ku),制(zhi)定隨(sui)(sui)(sui)機(ji)(ji)(ji)(ji)抽(chou)(chou)查(cha)工(gong)(gong)(gong)作(zuo)(zuo)細(xi)則,今(jin)年縣級以(yi)上政(zheng)府部門都要拿出(chu)“一(yi)(yi)單(dan)(dan)、兩(liang)庫(ku)、一(yi)(yi)細(xi)則”。隨(sui)(sui)(sui)機(ji)(ji)(ji)(ji)抽(chou)(chou)查(cha)事(shi)項,要達到(dao)本部門市(shi)場監(jian)(jian)管執(zhi)法事(shi)項的(de)(de)70%以(yi)上、其他行政(zheng)執(zhi)法事(shi)項的(de)(de)50%以(yi)上,力爭(zheng)2017年實現全覆蓋,充分體現監(jian)(jian)管的(de)(de)公(gong)平性(xing)、規范性(xing)和簡約性(xing),并與信(xin)用(yong)(yong)(yong)監(jian)(jian)管、智(zhi)能監(jian)(jian)管聯動,加(jia)強社會(hui)信(xin)用(yong)(yong)(yong)體系(xi)建(jian)設(she),充分發揮全國信(xin)用(yong)(yong)(yong)信(xin)息共享平臺作(zuo)(zuo)用(yong)(yong)(yong),推進(jin)實施守(shou)信(xin)聯合激(ji)勵和失信(xin)聯合懲戒(jie)工(gong)(gong)(gong)作(zuo)(zuo),加(jia)大“信(xin)用(yong)(yong)(yong)中(zhong)國”網站對(dui)失信(xin)行為的(de)(de)曝光力度。推進(jin)企業信(xin)用(yong)(yong)(yong)信(xin)息歸(gui)集公(gong)示工(gong)(gong)(gong)作(zuo)(zuo)。積極運用(yong)(yong)(yong)大數據、云計算、物(wu)聯網等信(xin)息技術(shu),建(jian)立健全市(shi)場主體誠(cheng)信(xin)檔案、行業黑名(ming)單(dan)(dan)制(zhi)度和市(shi)場退出(chu)機(ji)(ji)(ji)(ji)制(zhi)。(國家發展改革(ge)委、人(ren)民銀行、工(gong)(gong)(gong)商總(zong)局(ju)牽頭,海關(guan)總(zong)署、稅務總(zong)局(ju)、質(zhi)檢總(zong)局(ju)、食品(pin)藥品(pin)監(jian)(jian)管總(zong)局(ju)等相關(guan)部門按(an)職責(ze)分工(gong)(gong)(gong)負責(ze))
