新環保法實施中存在哪些瓶頸?

  2015年新(xin)《環保(bao)(bao)法》的(de)(de)實施,必將進一(yi)步增強政府的(de)(de)環保(bao)(bao)主體責(ze)任、環保(bao)(bao)部門的(de)(de)統(tong)一(yi)監管責(ze)任、企業的(de)(de)治(zhi)污責(ze)任、公眾(zhong)的(de)(de)監督(du)責(ze)任,有力地保(bao)(bao)障我國(guo)環保(bao)(bao)事業的(de)(de)健康發(fa)展。但新(xin)《環保(bao)(bao)法》實施中,仍然存在一(yi)些難點(dian)和(he)瓶頸,需要(yao)加(jia)以(yi)思考和(he)解決。

  新法實施中面臨的主要瓶頸

  地(di)方(fang)政(zheng)府的(de)環(huan)(huan)(huan)保(bao)主體責(ze)任(ren)(ren)凸顯不夠。新《環(huan)(huan)(huan)保(bao)法(fa)》第(di)六(liu)條規(gui)定(ding):地(di)方(fang)各(ge)(ge)級人民(min)政(zheng)府應當對(dui)本行政(zheng)區域(yu)的(de)環(huan)(huan)(huan)境(jing)(jing)質量負責(ze)。這明(ming)確界定(ding)了(le)地(di)方(fang)政(zheng)府的(de)環(huan)(huan)(huan)保(bao)主體責(ze)任(ren)(ren)。目(mu)前(qian),雖然地(di)方(fang)各(ge)(ge)級政(zheng)府的(de)環(huan)(huan)(huan)境(jing)(jing)意識有(you)了(le)不同(tong)程度的(de)提高,但是(shi)一些地(di)方(fang)政(zheng)府不能正確處理環(huan)(huan)(huan)保(bao)與發(fa)展(zhan)的(de)關系,認為經濟發(fa)展(zhan)是(shi)硬任(ren)(ren)務,環(huan)(huan)(huan)境(jing)(jing)保(bao)護是(shi)軟指標,一旦環(huan)(huan)(huan)保(bao)與發(fa)展(zhan)出現矛盾(dun)時往(wang)(wang)往(wang)(wang)舍(she)棄環(huan)(huan)(huan)保(bao)。雖然中央提出對(dui)領導干(gan)部實行生態(tai)環(huan)(huan)(huan)境(jing)(jing)損害責(ze)任(ren)(ren)終身追(zhui)究制(zhi),離任(ren)(ren)時要有(you)自然資源資產離任(ren)(ren)審計,但因目(mu)前(qian)尚未出臺(tai)實施細則而難以落實;對(dui)有(you)的(de)領導干(gan)部本應追(zhui)究環(huan)(huan)(huan)保(bao)責(ze)任(ren)(ren),也因無相(xiang)應追(zhui)責(ze)制(zhi)度而不了(le)了(le)之。

  環(huan)(huan)保(bao)(bao)部門(men)(men)統一監(jian)督管(guan)理難度(du)大。一是(shi)在(zai)(zai)職(zhi)能(neng)定位(wei)上,地方(fang)政府對環(huan)(huan)保(bao)(bao)部門(men)(men)定位(wei)千(qian)差萬別。二(er)是(shi)在(zai)(zai)監(jian)管(guan)體制上,環(huan)(huan)保(bao)(bao)部門(men)(men)平行(xing)于其(qi)他部門(men)(men),甚至被視作弱勢部門(men)(men)。三(san)是(shi)在(zai)(zai)監(jian)管(guan)職(zhi)能(neng)上,除環(huan)(huan)境保(bao)(bao)護部環(huan)(huan)監(jian)局(ju)及少數(shu)地方(fang)環(huan)(huan)監(jian)部門(men)(men)為(wei)(wei)公務員編(bian)制外,各(ge)地環(huan)(huan)監(jian)部門(men)(men)均為(wei)(wei)事業編(bian)制或參公管(guan)理事業編(bian)制。四是(shi)在(zai)(zai)監(jian)管(guan)能(neng)力上,部分(fen)地方(fang)以環(huan)(huan)境監(jian)察執(zhi)法(fa)未納入國務院(yuan)正式批準的(de)執(zhi)法(fa)序列為(wei)(wei)由(you),將基(ji)層(ceng)環(huan)(huan)境執(zhi)法(fa)車輛(liang)收回,執(zhi)法(fa)裝(zhuang)備(bei)配備(bei)也十(shi)分(fen)有(you)限。五是(shi)在(zai)(zai)監(jian)管(guan)力度(du)上,一些(xie)基(ji)層(ceng)環(huan)(huan)保(bao)(bao)部門(men)(men)由(you)于主客觀(guan)原因,監(jian)管(guan)執(zhi)法(fa)的(de)力度(du)依(yi)然偏軟。

  有關(guan)(guan)部(bu)(bu)門環(huan)保(bao)(bao)(bao)(bao)監督(du)(du)管(guan)理未形成(cheng)合力。新(xin)《環(huan)保(bao)(bao)(bao)(bao)法》第十條(tiao)規定:縣(xian)級以(yi)(yi)上人(ren)民政府有關(guan)(guan)部(bu)(bu)門和軍(jun)隊環(huan)境保(bao)(bao)(bao)(bao)護部(bu)(bu)門,依照有關(guan)(guan)法律的規定對(dui)資源保(bao)(bao)(bao)(bao)護和污染防(fang)治等環(huan)境保(bao)(bao)(bao)(bao)護工(gong)作實(shi)施監督(du)(du)管(guan)理。這明確界定了政府有關(guan)(guan)部(bu)(bu)門擔負環(huan)保(bao)(bao)(bao)(bao)監管(guan)的法定職(zhi)責(ze)。2014年華(hua)北環(huan)保(bao)(bao)(bao)(bao)督(du)(du)查中(zhong)心對(dui)華(hua)北地區(qu)14個重點城市(shi)(區(qu))開展了以(yi)(yi)督(du)(du)政為導(dao)向的環(huan)保(bao)(bao)(bao)(bao)綜合督(du)(du)查,對(dui)有關(guan)(guan)部(bu)(bu)門開展了調研走訪,發(fa)現主要存在職(zhi)責(ze)不清、不愿擔當、被動應(ying)付、推卸責(ze)任(ren)等問題。一(yi)旦出現問題,便將責(ze)任(ren)推至環(huan)保(bao)(bao)(bao)(bao)部(bu)(bu)門,地方政府追責(ze)時環(huan)保(bao)(bao)(bao)(bao)部(bu)(bu)門往往首當其沖。

  一些(xie)企(qi)(qi)事業單位守法(fa)(fa)(fa)自覺(jue)性不(bu)高。新《環(huan)(huan)保法(fa)(fa)(fa)》第六條(tiao)規定:企(qi)(qi)業事業單位和其他生產經營者(zhe)應(ying)當(dang)(dang)防止(zhi)、減(jian)少(shao)環(huan)(huan)境(jing)污染和生態破壞,對(dui)(dui)所造成的(de)(de)損害依法(fa)(fa)(fa)承擔責任。目前環(huan)(huan)境(jing)違(wei)法(fa)(fa)(fa)行(xing)為(wei)(wei)仍然(ran)多發,其根源是(shi)一些(xie)企(qi)(qi)事業單位守法(fa)(fa)(fa)的(de)(de)自覺(jue)性不(bu)高,主要表(biao)現(xian)在:一是(shi)不(bu)知而犯,尤(you)其是(shi)小企(qi)(qi)業主的(de)(de)環(huan)(huan)境(jing)常(chang)識(shi)不(bu)足(zu)、環(huan)(huan)境(jing)意識(shi)低下(xia)(xia),對(dui)(dui)環(huan)(huan)境(jing)違(wei)法(fa)(fa)(fa)渾然(ran)不(bu)覺(jue),對(dui)(dui)違(wei)法(fa)(fa)(fa)排污行(xing)為(wei)(wei)司空見慣(guan),不(bu)以為(wei)(wei)違(wei)法(fa)(fa)(fa);二是(shi)明知故犯,不(bu)少(shao)企(qi)(qi)業仍抱有(you)僥(jiao)幸心理,尤(you)其是(shi)企(qi)(qi)業在經濟(ji)效益(yi)不(bu)好的(de)(de)情況(kuang)下(xia)(xia),為(wei)(wei)獲得利潤想方(fang)設法(fa)(fa)(fa)逃避(bi)監管;三是(shi)惡意違(wei)法(fa)(fa)(fa),為(wei)(wei)追求效益(yi),在環(huan)(huan)保設施(shi)(shi)上做文章,不(bu)上環(huan)(huan)保設施(shi)(shi),或者(zhe)上了設施(shi)(shi)也不(bu)能(neng)正常(chang)運(yun)行(xing),運(yun)行(xing)起(qi)來(lai)又(you)不(bu)能(neng)達標排放。對(dui)(dui)此,增(zeng)強企(qi)(qi)事業單位守法(fa)(fa)(fa)的(de)(de)自覺(jue)性,無疑(yi)是(shi)當(dang)(dang)前最為(wei)(wei)迫(po)切的(de)(de)任務之一。

  公眾履(lv)行(xing)(xing)環(huan)(huan)(huan)保(bao)義(yi)務不(bu)到位。隨著社會(hui)經(jing)濟的發展,社會(hui)公眾的環(huan)(huan)(huan)境意(yi)識(shi)日益增強,但與(yu)新(xin)《環(huan)(huan)(huan)保(bao)法(fa)》的要求還有(you)(you)(you)差(cha)距,很多人不(bu)能(neng)(neng)正確(que)履(lv)行(xing)(xing)環(huan)(huan)(huan)保(bao)義(yi)務:一(yi)是(shi)有(you)(you)(you)的缺(que)乏環(huan)(huan)(huan)境意(yi)識(shi),不(bu)懂法(fa)、不(bu)知法(fa),對環(huan)(huan)(huan)境保(bao)護漠(mo)不(bu)關心(xin),聽之任(ren)之;二是(shi)有(you)(you)(you)的雖有(you)(you)(you)環(huan)(huan)(huan)境意(yi)識(shi),但不(bu)能(neng)(neng)親(qin)力親(qin)為踐行(xing)(xing)環(huan)(huan)(huan)保(bao)義(yi)務,一(yi)旦牽涉到個人利(li)益訴求,便(bian)言行(xing)(xing)不(bu)一(yi),甚至成為污染制造者;三是(shi)有(you)(you)(you)的缺(que)乏環(huan)(huan)(huan)保(bao)義(yi)務和責任(ren)感,對政(zheng)府提倡的環(huan)(huan)(huan)保(bao)行(xing)(xing)動不(bu)能(neng)(neng)積極(ji)參與(yu);四是(shi)有(you)(you)(you)的監督(du)意(yi)識(shi)不(bu)強,對環(huan)(huan)(huan)境違法(fa)行(xing)(xing)為不(bu)制止、不(bu)舉報(bao)。

  破除新法實施瓶頸的主要對策

  要(yao)(yao)實行(xing)黨政(zheng)(zheng)(zheng)(zheng)同(tong)責(ze)(ze)(ze)(ze),督(du)(du)促(cu)地(di)(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)切實落(luo)實環(huan)(huan)(huan)(huan)(huan)保(bao)(bao)(bao)主(zhu)(zhu)體責(ze)(ze)(ze)(ze)任(ren)。2015年全國環(huan)(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)(bao)護(hu)(hu)工(gong)(gong)(gong)作(zuo)會議明確提出要(yao)(yao)著(zhu)力推動“黨政(zheng)(zheng)(zheng)(zheng)同(tong)責(ze)(ze)(ze)(ze)”、“一崗雙責(ze)(ze)(ze)(ze)”,把生態文明建(jian)設(she)作(zuo)為地(di)(di)(di)方(fang)(fang)黨政(zheng)(zheng)(zheng)(zheng)領(ling)(ling)(ling)導班子和領(ling)(ling)(ling)導干(gan)(gan)部(bu)(bu)政(zheng)(zheng)(zheng)(zheng)績考核評價重要(yao)(yao)內容。當前,應凸顯黨委的環(huan)(huan)(huan)(huan)(huan)保(bao)(bao)(bao)領(ling)(ling)(ling)導責(ze)(ze)(ze)(ze)任(ren)。地(di)(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)對轄區環(huan)(huan)(huan)(huan)(huan)境(jing)質(zhi)量負有(you)(you)法定職(zhi)責(ze)(ze)(ze)(ze)。黨委在資(zi)源配置、發展導向(xiang)、人事安排等方(fang)(fang)面具有(you)(you)決定性(xing)作(zuo)用(yong),在嚴峻的環(huan)(huan)(huan)(huan)(huan)境(jing)形勢下(xia),一旦(dan)黨委領(ling)(ling)(ling)導責(ze)(ze)(ze)(ze)任(ren)虛化(hua),將不可避免地(di)(di)(di)導致政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)環(huan)(huan)(huan)(huan)(huan)保(bao)(bao)(bao)工(gong)(gong)(gong)作(zuo)出現不確定性(xing)。因(yin)此(ci),完善(shan)黨政(zheng)(zheng)(zheng)(zheng)領(ling)(ling)(ling)導干(gan)(gan)部(bu)(bu)考核和評價機制(zhi),建(jian)立健全黨委環(huan)(huan)(huan)(huan)(huan)保(bao)(bao)(bao)工(gong)(gong)(gong)作(zuo)領(ling)(ling)(ling)導機制(zhi)已(yi)是當務(wu)之急。要(yao)(yao)不斷深(shen)化(hua)督(du)(du)政(zheng)(zheng)(zheng)(zheng)工(gong)(gong)(gong)作(zuo),以(yi)(yi)環(huan)(huan)(huan)(huan)(huan)保(bao)(bao)(bao)綜合督(du)(du)查為主(zhu)(zhu)要(yao)(yao)形式,以(yi)(yi)地(di)(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)為主(zhu)(zhu)要(yao)(yao)督(du)(du)查對象(xiang),從(cong)經濟(ji)發展與(yu)環(huan)(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)(bao)護(hu)(hu)關系著(zhu)眼(yan),從(cong)地(di)(di)(di)方(fang)(fang)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)、有(you)(you)關職(zhi)能(neng)部(bu)(bu)門、排污單位(wei)等不同(tong)責(ze)(ze)(ze)(ze)任(ren)主(zhu)(zhu)體著(zhu)手(shou),對政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)履責(ze)(ze)(ze)(ze)不到位(wei)的采取通(tong)報、約(yue)談、限批等方(fang)(fang)式,推動政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)切實承擔(dan)起環(huan)(huan)(huan)(huan)(huan)保(bao)(bao)(bao)主(zhu)(zhu)體責(ze)(ze)(ze)(ze)任(ren)和發揮(hui)統領(ling)(ling)(ling)作(zuo)用(yong),使地(di)(di)(di)方(fang)(fang)經濟(ji)發展與(yu)環(huan)(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)(bao)護(hu)(hu)得以(yi)(yi)協調推進,環(huan)(huan)(huan)(huan)(huan)境(jing)質(zhi)量得以(yi)(yi)不斷改善(shan)。近期,環(huan)(huan)(huan)(huan)(huan)境(jing)保(bao)(bao)(bao)護(hu)(hu)部(bu)(bu)華北(bei)督(du)(du)查中(zhong)心約(yue)談了(le)環(huan)(huan)(huan)(huan)(huan)境(jing)問題較多的河(he)南安陽(yang)市(shi)和河(he)北(bei)滄州、承德(de)市(shi)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu),有(you)(you)力地(di)(di)(di)促(cu)進了(le)問題整(zheng)改。

  要(yao)加(jia)強(qiang)人(ren)(ren)(ren)大(da)、政(zheng)協(xie)(xie)監(jian)(jian)(jian)督(du)(du)(du)(du)(du),督(du)(du)(du)(du)(du)促(cu)政(zheng)府(fu)(fu)強(qiang)化環(huan)保(bao)(bao)履責。人(ren)(ren)(ren)大(da)監(jian)(jian)(jian)督(du)(du)(du)(du)(du)是(shi)(shi)憲法(fa)(fa)(fa)(fa)賦(fu)予(yu)人(ren)(ren)(ren)大(da)及(ji)其(qi)常委會的重(zhong)要(yao)職權,負有(you)監(jian)(jian)(jian)督(du)(du)(du)(du)(du)本級(ji)人(ren)(ren)(ren)民政(zheng)府(fu)(fu)工作之責;民主監(jian)(jian)(jian)督(du)(du)(du)(du)(du)是(shi)(shi)憲法(fa)(fa)(fa)(fa)賦(fu)予(yu)政(zheng)協(xie)(xie)的重(zhong)要(yao)職能(neng),是(shi)(shi)政(zheng)協(xie)(xie)實(shi)(shi)施黨(dang)外監(jian)(jian)(jian)督(du)(du)(du)(du)(du)的有(you)效(xiao)形(xing)式。尤其(qi)是(shi)(shi)面(mian)對嚴(yan)峻的環(huan)境形(xing)勢和(he)(he)廣大(da)人(ren)(ren)(ren)民群眾的迫切期待(dai),推動新《環(huan)保(bao)(bao)法(fa)(fa)(fa)(fa)》有(you)效(xiao)實(shi)(shi)施,人(ren)(ren)(ren)大(da)和(he)(he)政(zheng)協(xie)(xie)的監(jian)(jian)(jian)督(du)(du)(du)(du)(du)必不可(ke)少。一方(fang)面(mian),人(ren)(ren)(ren)大(da)應積(ji)極監(jian)(jian)(jian)督(du)(du)(du)(du)(du)政(zheng)府(fu)(fu)履行環(huan)保(bao)(bao)職責,通(tong)過專題調(diao)(diao)研、實(shi)(shi)地考察、明察暗訪、問卷調(diao)(diao)查等多種形(xing)式,全面(mian)了解環(huan)保(bao)(bao)真實(shi)(shi)狀況(kuang),督(du)(du)(du)(du)(du)促(cu)政(zheng)府(fu)(fu)嚴(yan)格依(yi)法(fa)(fa)(fa)(fa)行政(zheng);政(zheng)協(xie)(xie)應主動開(kai)展熱點調(diao)(diao)研,深入開(kai)展民主監(jian)(jian)(jian)督(du)(du)(du)(du)(du),充(chong)分(fen)發揮參(can)政(zheng)議(yi)政(zheng)職能(neng),對黨(dang)委和(he)(he)政(zheng)府(fu)(fu)落實(shi)(shi)環(huan)保(bao)(bao)主體責任方(fang)面(mian)提出(chu)及(ji)時批評(ping)和(he)(he)建設性建議(yi),推動地方(fang)政(zheng)府(fu)(fu)主動接受監(jian)(jian)(jian)督(du)(du)(du)(du)(du)、重(zhong)視監(jian)(jian)(jian)督(du)(du)(du)(du)(du)、落實(shi)(shi)監(jian)(jian)(jian)督(du)(du)(du)(du)(du)。另一方(fang)面(mian),人(ren)(ren)(ren)大(da)在加(jia)快修訂和(he)(he)完(wan)善與新《環(huan)保(bao)(bao)法(fa)(fa)(fa)(fa)》配套(tao)的各專業法(fa)(fa)(fa)(fa)的同時,應充(chong)分(fen)重(zhong)視與法(fa)(fa)(fa)(fa)律配套(tao)的行政(zheng)法(fa)(fa)(fa)(fa)規(gui)、規(gui)章制訂不及(ji)時的問題,將督(du)(du)(du)(du)(du)促(cu)國務(wu)院和(he)(he)相關部門及(ji)時出(chu)臺相關法(fa)(fa)(fa)(fa)規(gui)、規(gui)章作為當前重(zhong)要(yao)職責,確保(bao)(bao)新《環(huan)保(bao)(bao)法(fa)(fa)(fa)(fa)》有(you)效(xiao)實(shi)(shi)施。

  要不(bu)(bu)斷完善環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)體制(zhi),保(bao)(bao)(bao)(bao)(bao)障環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)部(bu)(bu)門(men)統(tong)一(yi)(yi)實(shi)施(shi)監(jian)管(guan)(guan)(guan)。為(wei)(wei)解(jie)決當前環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)部(bu)(bu)門(men)監(jian)管(guan)(guan)(guan)的統(tong)籌性和(he)權威性不(bu)(bu)足的苛疾,需(xu)要對現(xian)行(xing)(xing)環(huan)(huan)(huan)境(jing)(jing)管(guan)(guan)(guan)理體制(zhi)進行(xing)(xing)改(gai)革。一(yi)(yi)是(shi)建議在政府(fu)層(ceng)面成立環(huan)(huan)(huan)境(jing)(jing)保(bao)(bao)(bao)(bao)(bao)護委(wei)(wei)員(yuan)會,探索和(he)完善大環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)體制(zhi),強化(hua)(hua)環(huan)(huan)(huan)境(jing)(jing)與(yu)發展的綜合決策和(he)協調機制(zhi),使環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)工作(zuo)由單一(yi)(yi)的污(wu)染源監(jian)管(guan)(guan)(guan)上升(sheng)到對空間格(ge)局、產業(ye)結構、資源配置的調控和(he)優化(hua)(hua)。如山西(xi)省長(chang)治市成立了環(huan)(huan)(huan)境(jing)(jing)保(bao)(bao)(bao)(bao)(bao)護委(wei)(wei)員(yuan)會,市長(chang)為(wei)(wei)主(zhu)任(ren),分管(guan)(guan)(guan)副(fu)市長(chang)為(wei)(wei)副(fu)主(zhu)任(ren),辦公室設在環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)局,政府(fu)有(you)關部(bu)(bu)門(men)設立環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)科,有(you)效地增強了環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)統(tong)一(yi)(yi)監(jian)管(guan)(guan)(guan)職能(neng)。二是(shi)適(shi)當歸并環(huan)(huan)(huan)境(jing)(jing)監(jian)管(guan)(guan)(guan)職能(neng),減(jian)少(shao)職能(neng)交叉,有(you)序整合并明(ming)確分散在不(bu)(bu)同(tong)(tong)領域、不(bu)(bu)同(tong)(tong)部(bu)(bu)門(men)、不(bu)(bu)同(tong)(tong)層(ceng)次(ci)的監(jian)管(guan)(guan)(guan)職能(neng),逐步建立統(tong)籌有(you)力、運行(xing)(xing)高效的環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)統(tong)一(yi)(yi)監(jian)管(guan)(guan)(guan)格(ge)局。三是(shi)授權環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)部(bu)(bu)門(men)按照環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)責任(ren)目標,定期對各行(xing)(xing)業(ye)、各部(bu)(bu)門(men)組(zu)織(zhi)開展環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)目標考核,強化(hua)(hua)環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)約(yue)束機制(zhi)。四是(shi)強化(hua)(hua)環(huan)(huan)(huan)保(bao)(bao)(bao)(bao)(bao)部(bu)(bu)門(men)能(neng)力建設,明(ming)確將環(huan)(huan)(huan)境(jing)(jing)執(zhi)(zhi)(zhi)法(fa)納(na)入行(xing)(xing)政執(zhi)(zhi)(zhi)法(fa)序列,統(tong)一(yi)(yi)服(fu)裝,保(bao)(bao)(bao)(bao)(bao)障裝備(bei),增加編制(zhi),盡(jin)快(kuai)改(gai)變現(xian)行(xing)(xing)委(wei)(wei)托(tuo)執(zhi)(zhi)(zhi)法(fa)地位,切實(shi)加大環(huan)(huan)(huan)境(jing)(jing)監(jian)管(guan)(guan)(guan)執(zhi)(zhi)(zhi)法(fa)力度(du)。

  要(yao)(yao)強(qiang)化(hua)有關部門環(huan)(huan)(huan)保(bao)(bao)責(ze)(ze)(ze)任(ren),促(cu)成權責(ze)(ze)(ze)相匹配的(de)分工(gong)合作格局。一切單位和個(ge)人都有保(bao)(bao)護(hu)環(huan)(huan)(huan)境的(de)義務(wu)。加強(qiang)環(huan)(huan)(huan)境監督管理(li),各有關部門必須齊抓共管,形成合力。一是要(yao)(yao)增(zeng)強(qiang)認識,勇于擔(dan)當。二是明晰職能,責(ze)(ze)(ze)任(ren)到位。三是部門聯動,形成合力。大(da)力推(tui)動環(huan)(huan)(huan)保(bao)(bao)與(yu)城建、國(guo)土、水(shui)利(li)(水(shui)務(wu))、公安、農業(ye)、工(gong)信等部門的(de)聯動。四(si)是嚴格考核(he),實(shi)行(xing)問責(ze)(ze)(ze)。在考核(he)政府環(huan)(huan)(huan)保(bao)(bao)履責(ze)(ze)(ze)的(de)同時,應對各有關部門的(de)環(huan)(huan)(huan)保(bao)(bao)履責(ze)(ze)(ze)情況進行(xing)考核(he),并納入領導干部考核(he)評價體系。

  要(yao)(yao)落(luo)(luo)實(shi)企業(ye)治(zhi)污(wu)責任,強化守(shou)法(fa)(fa)的(de)自覺性。立法(fa)(fa)、執法(fa)(fa)、司法(fa)(fa),最終還是(shi)要(yao)(yao)落(luo)(luo)到守(shou)法(fa)(fa)上(shang)來。從目前情況(kuang)看,加(jia)大執法(fa)(fa)力度(du)是(shi)一方(fang)面,更(geng)重(zhong)要(yao)(yao)的(de)是(shi)企業(ye)要(yao)(yao)自律(lv)守(shou)法(fa)(fa)。對此,要(yao)(yao)多措并舉,綜合施策。一是(shi)在(zai)(zai)(zai)思想上(shang),使排(pai)污(wu)者(zhe)(zhe)不愿違(wei)法(fa)(fa)。要(yao)(yao)通(tong)過(guo)各(ge)種形(xing)式的(de)宣傳(chuan),強化企業(ye)的(de)守(shou)法(fa)(fa)意識。二是(shi)在(zai)(zai)(zai)制(zhi)度(du)上(shang),使排(pai)污(wu)者(zhe)(zhe)不能違(wei)法(fa)(fa)。按照新《環保法(fa)(fa)》的(de)總體原則和(he)要(yao)(yao)求(qiu),配套相(xiang)應(ying)的(de)制(zhi)度(du)規(gui)定,把制(zhi)度(du)籠子扎緊(jin),不讓(rang)違(wei)法(fa)(fa)者(zhe)(zhe)有機可乘。三是(shi)在(zai)(zai)(zai)執法(fa)(fa)上(shang),使排(pai)污(wu)者(zhe)(zhe)不敢(gan)違(wei)法(fa)(fa)。要(yao)(yao)堅(jian)持鐵腕執法(fa)(fa),嚴厲處罰,加(jia)強與公安的(de)合作,加(jia)大執法(fa)(fa)力度(du)。四是(shi)在(zai)(zai)(zai)經濟上(shang),運用各(ge)種經濟手段,利(li)用經濟杠桿激(ji)勵和(he)約束企業(ye),對企業(ye)利(li)益(yi)進行調節,促使企業(ye)守(shou)法(fa)(fa)自律(lv)。
