司法鑒定資質認(ren)定能力(li)提(ti)升三年行動方案

為(wei)深(shen)入貫徹落實中辦、國辦《關(guan)于健全統一司法(fa)(fa)(fa)鑒(jian)定(ding)(ding)(ding)管理體制的(de)實施意(yi)見》、《司法(fa)(fa)(fa)部關(guan)于進一步深(shen)化改革 強化監管 提(ti)(ti)高司法(fa)(fa)(fa)鑒(jian)定(ding)(ding)(ding)質(zhi)量(liang)和公(gong)信力(li)(li)的(de)意(yi)見》(司發(fa)(fa)〔2020〕1號(hao))、《“十四五”司法(fa)(fa)(fa)行(xing)政事業(ye)發(fa)(fa)展規劃》(司發(fa)(fa)〔2021〕4號(hao))、《檢(jian)驗檢(jian)測(ce)機構資(zi)質(zhi)認定(ding)(ding)(ding)管理辦法(fa)(fa)(fa)》(質(zhi)檢(jian)總局令第163號(hao))等(deng)規定(ding)(ding)(ding),進一步深(shen)化、創新司法(fa)(fa)(fa)鑒(jian)定(ding)(ding)(ding)資(zi)質(zhi)認定(ding)(ding)(ding)工作(zuo),不(bu)斷提(ti)(ti)升司法(fa)(fa)(fa)鑒(jian)定(ding)(ding)(ding)質(zhi)量(liang)和公(gong)信力(li)(li),促進行(xing)業(ye)高質(zhi)量(liang)發(fa)(fa)展,結合(he)司法(fa)(fa)(fa)鑒(jian)定(ding)(ding)(ding)行(xing)業(ye)現(xian)狀和工作(zuo)實際(ji),從2022年始到2024年末(mo),開展為(wei)期三年的(de)司法(fa)(fa)(fa)鑒(jian)定(ding)(ding)(ding)資(zi)質(zhi)認定(ding)(ding)(ding)能力(li)(li)提(ti)(ti)升行(xing)動,制定(ding)(ding)(ding)如下方案(an)。

三、工作目標
(一)依法(fa)(fa)有序(xu)擴大資質(zhi)認(ren)定(ding)(ding)覆蓋面。嚴格做好規定(ding)(ding)范圍(wei)內司法(fa)(fa)鑒(jian)定(ding)(ding)資質(zhi)認(ren)定(ding)(ding)工(gong)作,根據工(gong)作發展適時動(dong)態調(diao)整司法(fa)(fa)鑒(jian)定(ding)(ding)資質(zhi)認(ren)定(ding)(ding)項(xiang)目(mu),充分(fen)滿足行業管理(li)和(he)質(zhi)量建設需(xu)求。到2022年底(di),從事規定(ding)(ding)范圍(wei)內司法(fa)(fa)鑒(jian)定(ding)(ding)業務的法(fa)(fa)人或者其他組織的檢測實驗室應當依法(fa)(fa)通過資質(zhi)管理(li),全面提升技術能(neng)力(li)。
(二)大力加強評審(shen)員(yuan)隊(dui)伍建設(she)。逐(zhu)步擴大司法(fa)鑒定(ding)資質(zhi)認定(ding)評審(shen)員(yuan)隊(dui)伍規模,加強能力建設(she),充分滿足評審(shen)和(he)管理需要(yao)。到2022年(nian)底,基本建成覆蓋全(quan)面、結構(gou)合(he)理的司法(fa)鑒定(ding)資質(zhi)認定(ding)評審(shen)員(yuan)庫(ku)。
(三)建(jian)(jian)立健全質(zhi)量管(guan)(guan)(guan)控體系(xi)。持續提高司法鑒定(ding)機(ji)構內部管(guan)(guan)(guan)理(li)水平,切實抓好質(zhi)量建(jian)(jian)設,努力保證鑒定(ding)過(guo)程的(de)規范性(xing)和(he)鑒定(ding)結果(guo)的(de)科(ke)學(xue)性(xing)。到2024年底,有章可(ke)循(xun)、系(xi)統(tong)全面(mian)、防控風險、持續有效(xiao)的(de)質(zhi)量管(guan)(guan)(guan)理(li)體系(xi)建(jian)(jian)立健全并有效(xiao)運行(xing)。
(四)全面(mian)提升質量(liang)管(guan)理(li)(li)能(neng)力水平。持(chi)續提升行政(zheng)管(guan)理(li)(li)干部、行業(ye)協會管(guan)理(li)(li)人員專業(ye)素質和管(guan)理(li)(li)能(neng)力。到2024年底,培(pei)養一批熟(shu)法律(lv)、懂政(zheng)策、有能(neng)力、善管(guan)理(li)(li)、會監(jian)督司法鑒定(ding)機(ji)構合規(gui)運營的管(guan)理(li)(li)干部,確保司法鑒定(ding)行業(ye)監(jian)管(guan)水平科(ke)學、穩步(bu)提升。
四(si)、主要任務
(一)建立(li)司法(fa)(fa)(fa)(fa)鑒(jian)(jian)定(ding)(ding)(ding)(ding)(ding)資(zi)(zi)(zi)質(zhi)(zhi)認(ren)(ren)(ren)定(ding)(ding)(ding)(ding)(ding)項目(mu)(mu)動態(tai)調整機制。法(fa)(fa)(fa)(fa)人或者(zhe)其他組織(zhi)從事(shi)法(fa)(fa)(fa)(fa)醫(yi)物證(zheng)、法(fa)(fa)(fa)(fa)醫(yi)毒物、微(wei)量(liang)物證(zheng)和(he)環(huan)境(jing)損害司法(fa)(fa)(fa)(fa)鑒(jian)(jian)定(ding)(ding)(ding)(ding)(ding)業(ye)務的(de),應(ying)(ying)(ying)當(dang)具備相應(ying)(ying)(ying)的(de)通(tong)(tong)過資(zi)(zi)(zi)質(zhi)(zhi)認(ren)(ren)(ren)定(ding)(ding)(ding)(ding)(ding)的(de)檢(jian)測實驗室。結(jie)合(he)司法(fa)(fa)(fa)(fa)鑒(jian)(jian)定(ding)(ding)(ding)(ding)(ding)行(xing)(xing)業(ye)發展狀況,為更好地服務訴(su)訟(song)活動,從事(shi)聲像資(zi)(zi)(zi)料司法(fa)(fa)(fa)(fa)鑒(jian)(jian)定(ding)(ding)(ding)(ding)(ding)業(ye)務的(de)法(fa)(fa)(fa)(fa)人或者(zhe)其他組織(zhi)應(ying)(ying)(ying)當(dang)盡快申請資(zi)(zi)(zi)質(zhi)(zhi)認(ren)(ren)(ren)定(ding)(ding)(ding)(ding)(ding),自2023年1月(yue)1日起仍未通(tong)(tong)過的(de),司法(fa)(fa)(fa)(fa)行(xing)(xing)政機關應(ying)(ying)(ying)當(dang)依法(fa)(fa)(fa)(fa)依規處理。司法(fa)(fa)(fa)(fa)鑒(jian)(jian)定(ding)(ding)(ding)(ding)(ding)資(zi)(zi)(zi)質(zhi)(zhi)認(ren)(ren)(ren)定(ding)(ding)(ding)(ding)(ding)項目(mu)(mu)詳見附件《司法(fa)(fa)(fa)(fa)鑒(jian)(jian)定(ding)(ding)(ding)(ding)(ding)檢(jian)測實驗室資(zi)(zi)(zi)質(zhi)(zhi)認(ren)(ren)(ren)定(ding)(ding)(ding)(ding)(ding)項目(mu)(mu)分類表(2022版)》(以下簡稱《分類表》)。司法(fa)(fa)(fa)(fa)部和(he)市場(chang)監管總(zong)局(ju)將根(gen)據司法(fa)(fa)(fa)(fa)鑒(jian)(jian)定(ding)(ding)(ding)(ding)(ding)行(xing)(xing)業(ye)發展和(he)工(gong)作實際(ji),對(dui)司法(fa)(fa)(fa)(fa)鑒(jian)(jian)定(ding)(ding)(ding)(ding)(ding)資(zi)(zi)(zi)質(zhi)(zhi)認(ren)(ren)(ren)定(ding)(ding)(ding)(ding)(ding)項目(mu)(mu)進行(xing)(xing)動態(tai)調整,并在此基礎(chu)上細化(hua)相關標(biao)準(zhun),指導全(quan)國(guo)統一開展司法(fa)(fa)(fa)(fa)鑒(jian)(jian)定(ding)(ding)(ding)(ding)(ding)資(zi)(zi)(zi)質(zhi)(zhi)認(ren)(ren)(ren)定(ding)(ding)(ding)(ding)(ding)工(gong)作。
(二)規(gui)范(fan)司(si)法(fa)鑒定(ding)資(zi)(zi)質認(ren)定(ding)工作程(cheng)序(xu)。進(jin)(jin)一步(bu)規(gui)范(fan)申(shen)(shen)(shen)請(qing)主(zhu)體(ti)(ti),從(cong)事(shi)法(fa)醫物(wu)證(zheng)(zheng)、法(fa)醫毒物(wu)、微(wei)(wei)量物(wu)證(zheng)(zheng)、聲像資(zi)(zi)料(liao)、環境(jing)損害鑒定(ding)業務的(de)司(si)法(fa)鑒定(ding)機構,應(ying)(ying)當(dang)以其設立主(zhu)體(ti)(ti)向市(shi)場(chang)監管(guan)部(bu)門(men)提出資(zi)(zi)質認(ren)定(ding)申(shen)(shen)(shen)請(qing)。進(jin)(jin)一步(bu)明確受理(li)(li)范(fan)圍,市(shi)場(chang)監管(guan)部(bu)門(men)僅(jin)受理(li)(li)《分類表》內(nei)的(de)資(zi)(zi)質認(ren)定(ding)項(xiang)目申(shen)(shen)(shen)請(qing)。進(jin)(jin)一步(bu)嚴(yan)格(ge)評(ping)審要求,資(zi)(zi)質認(ren)定(ding)嚴(yan)格(ge)按照評(ping)審準則進(jin)(jin)行,以告知承諾方式申(shen)(shen)(shen)請(qing)資(zi)(zi)質認(ren)定(ding)的(de),市(shi)場(chang)監管(guan)部(bu)門(men)應(ying)(ying)當(dang)及時(shi)(shi)開展現(xian)場(chang)核(he)查。進(jin)(jin)一步(bu)加強國家級(ji)(ji)資(zi)(zi)質認(ren)定(ding)管(guan)理(li)(li),嚴(yan)格(ge)按照《司(si)法(fa)部(bu) 國家市(shi)場(chang)監督管(guan)理(li)(li)總(zong)局關于(yu)加快推進(jin)(jin)司(si)法(fa)鑒定(ding)資(zi)(zi)質認(ren)定(ding)工作的(de)指(zhi)導意見(jian)》(司(si)規(gui)〔2019〕4號)規(gui)定(ding)的(de)申(shen)(shen)(shen)請(qing)條件(jian)和程(cheng)序(xu)申(shen)(shen)(shen)請(qing)國家級(ji)(ji)資(zi)(zi)質認(ren)定(ding);同時(shi)(shi)取(qu)得國家級(ji)(ji)和省級(ji)(ji)資(zi)(zi)質認(ren)定(ding)的(de),取(qu)證(zheng)(zheng)機構應(ying)(ying)當(dang)主(zhu)動(dong)注銷一項(xiang),避免重復取(qu)證(zheng)(zheng)。
(三)加(jia)強資(zi)質(zhi)認(ren)定(ding)(ding)工(gong)作(zuo)(zuo)(zuo)(zuo)體制(zhi)(zhi)機(ji)(ji)(ji)制(zhi)(zhi)建設。建立(li)重大決策溝通機(ji)(ji)(ji)制(zhi)(zhi),省級(ji)司法(fa)(fa)行(xing)(xing)政機(ji)(ji)(ji)關(guan)(guan)和市場(chang)監管部門加(jia)快研究制(zhi)(zhi)定(ding)(ding)相關(guan)(guan)政策文件,明確司法(fa)(fa)鑒(jian)(jian)定(ding)(ding)資(zi)質(zhi)認(ren)定(ding)(ding)受理范(fan)圍(wei)、申(shen)請條件和工(gong)作(zuo)(zuo)(zuo)(zuo)流(liu)(liu)程,進一(yi)步加(jia)強工(gong)作(zuo)(zuo)(zuo)(zuo)銜(xian)接(jie),明確管理職責,提高工(gong)作(zuo)(zuo)(zuo)(zuo)效率。建立(li)司法(fa)(fa)鑒(jian)(jian)定(ding)(ding)機(ji)(ji)(ji)構(gou)專家評審(shen)(shen)與資(zi)質(zhi)認(ren)定(ding)(ding)評審(shen)(shen)聯(lian)(lian)動(dong)機(ji)(ji)(ji)制(zhi)(zhi),對于(yu)新申(shen)請從(cong)事或者已經審(shen)(shen)核(he)登記的司法(fa)(fa)鑒(jian)(jian)定(ding)(ding)機(ji)(ji)(ji)構(gou)申(shen)請增加(jia)《分類表》內業(ye)務范(fan)圍(wei)的,如具備同步評審(shen)(shen)條件,司法(fa)(fa)行(xing)(xing)政機(ji)(ji)(ji)關(guan)(guan)與市場(chang)監管部門同步按各自評審(shen)(shen)要求開展現場(chang)考評,“一(yi)次性”完成評審(shen)(shen)工(gong)作(zuo)(zuo)(zuo)(zuo)。建立(li)完善工(gong)作(zuo)(zuo)(zuo)(zuo)協作(zuo)(zuo)(zuo)(zuo)機(ji)(ji)(ji)制(zhi)(zhi),各省級(ji)司法(fa)(fa)行(xing)(xing)政機(ji)(ji)(ji)關(guan)(guan)和市場(chang)監管部門之間加(jia)強信息共享交流(liu)(liu)和工(gong)作(zuo)(zuo)(zuo)(zuo)聯(lian)(lian)動(dong),加(jia)強司法(fa)(fa)鑒(jian)(jian)定(ding)(ding)資(zi)質(zhi)認(ren)定(ding)(ding)與行(xing)(xing)業(ye)登記管理工(gong)作(zuo)(zuo)(zuo)(zuo)的銜(xian)接(jie),以資(zi)質(zhi)認(ren)定(ding)(ding)工(gong)作(zuo)(zuo)(zuo)(zuo)為重要抓(zhua)手,持續(xu)提高司法(fa)(fa)鑒(jian)(jian)定(ding)(ding)行(xing)(xing)政許可規范(fan)化水平。
(四)發揮(hui)(hui)行(xing)(xing)業(ye)評(ping)審組(zu)職能作(zuo)(zuo)用。進(jin)一步(bu)發揮(hui)(hui)國(guo)家資(zi)(zi)質(zhi)(zhi)(zhi)認定(ding)(ding)司法(fa)鑒(jian)定(ding)(ding)評(ping)審組(zu)作(zuo)(zuo)用,積極協助(zhu)市(shi)場(chang)監(jian)管總(zong)局開展國(guo)家級(ji)資(zi)(zi)質(zhi)(zhi)(zhi)認定(ding)(ding)技術(shu)評(ping)審的組(zu)織和(he)(he)協調工(gong)作(zuo)(zuo);組(zu)織開展司法(fa)鑒(jian)定(ding)(ding)資(zi)(zi)質(zhi)(zhi)(zhi)認定(ding)(ding)評(ping)審員(yuan)的推薦報名(ming)、日常管理和(he)(he)繼續(xu)教(jiao)育培訓等(deng)工(gong)作(zuo)(zuo),不斷提高評(ping)審專家隊伍履職能力和(he)(he)專業(ye)水(shui)平。進(jin)一步(bu)發揮(hui)(hui)行(xing)(xing)業(ye)專家聚(ju)集優勢,積極協助(zhu)市(shi)場(chang)監(jian)管部門(men)和(he)(he)司法(fa)行(xing)(xing)政機關(guan)開展司法(fa)鑒(jian)定(ding)(ding)資(zi)(zi)質(zhi)(zhi)(zhi)認定(ding)(ding)技術(shu)要(yao)求制(zhi)定(ding)(ding)、司法(fa)鑒(jian)定(ding)(ding)行(xing)(xing)業(ye)檢測(ce)實驗(yan)室(shi)能力驗(yan)證等(deng)工(gong)作(zuo)(zuo),不斷提升司法(fa)鑒(jian)定(ding)(ding)資(zi)(zi)質(zhi)(zhi)(zhi)認定(ding)(ding)工(gong)作(zuo)(zuo)質(zhi)(zhi)(zhi)量。有條件的地區可以組(zu)建(jian)省級(ji)資(zi)(zi)質(zhi)(zhi)(zhi)認定(ding)(ding)司法(fa)鑒(jian)定(ding)(ding)評(ping)審組(zu)。
(五(wu))加強(qiang)評(ping)(ping)審(shen)(shen)(shen)(shen)能(neng)力建設(she)。進一步嚴格評(ping)(ping)審(shen)(shen)(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)考核要(yao)求(qiu),加強(qiang)評(ping)(ping)審(shen)(shen)(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)教育培訓投入,三年內實現國家(jia)級司(si)法鑒定資(zi)質(zhi)認(ren)定主任評(ping)(ping)審(shen)(shen)(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)、評(ping)(ping)審(shen)(shen)(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)、技(ji)術專家(jia)和(he)省級評(ping)(ping)審(shen)(shen)(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)師資(zi)培訓全覆(fu)蓋。通過(guo)制定評(ping)(ping)審(shen)(shen)(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)能(neng)力建設(she)實施細則(ze)、編制評(ping)(ping)審(shen)(shen)(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)考核練習題(ti)庫、聯(lian)合開展評(ping)(ping)審(shen)(shen)(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)監督管理(li)等(deng)多(duo)種方式,多(duo)維度綜合提(ti)升評(ping)(ping)審(shen)(shen)(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)能(neng)力,努力滿足資(zi)質(zhi)認(ren)定評(ping)(ping)審(shen)(shen)(shen)(shen)和(he)管理(li)需要(yao)。評(ping)(ping)審(shen)(shen)(shen)(shen)人員(yuan)(yuan)(yuan)(yuan)(yuan)應當(dang)堅持客(ke)觀公正,遵守行為規(gui)范(fan),執行評(ping)(ping)審(shen)(shen)(shen)(shen)程序,不得擅自增加或者減少評(ping)(ping)審(shen)(shen)(shen)(shen)范(fan)圍,降低評(ping)(ping)審(shen)(shen)(shen)(shen)要(yao)求(qiu),影響評(ping)(ping)審(shen)(shen)(shen)(shen)結果。
(六)加強執業能(neng)(neng)(neng)力(li)建(jian)設。司(si)(si)法(fa)(fa)行政機(ji)(ji)關(guan)用三年時間,分(fen)期分(fen)批分(fen)類開展司(si)(si)法(fa)(fa)鑒(jian)(jian)(jian)定機(ji)(ji)構(gou)管(guan)(guan)理(li)人員、鑒(jian)(jian)(jian)定人全覆蓋(gai)培訓,重(zhong)點針對司(si)(si)法(fa)(fa)鑒(jian)(jian)(jian)定機(ji)(ji)構(gou)管(guan)(guan)理(li)層、質(zhi)量(liang)負責人、技(ji)(ji)術負責人等(deng)關(guan)鍵(jian)崗位開展涵(han)蓋(gai)法(fa)(fa)律法(fa)(fa)規、政策要求、技(ji)(ji)術能(neng)(neng)(neng)力(li)和過(guo)程控制(zhi)等(deng)方面(mian)的教育(yu)培訓,持(chi)續提高司(si)(si)法(fa)(fa)鑒(jian)(jian)(jian)定機(ji)(ji)構(gou)質(zhi)量(liang)建(jian)設和內部管(guan)(guan)理(li)能(neng)(neng)(neng)力(li)。加強司(si)(si)法(fa)(fa)鑒(jian)(jian)(jian)定實踐能(neng)(neng)(neng)力(li)建(jian)設,組織專(zhuan)家深入司(si)(si)法(fa)(fa)鑒(jian)(jian)(jian)定機(ji)(ji)構(gou),開展實操指導和場景(jing)演練(lian),引導司(si)(si)法(fa)(fa)鑒(jian)(jian)(jian)定機(ji)(ji)構(gou)健全并運(yun)行有章可循、系統全面(mian)、持(chi)續有效的管(guan)(guan)理(li)體系,全面(mian)提升執業能(neng)(neng)(neng)力(li)。
(七)加(jia)強(qiang)管(guan)(guan)理(li)(li)(li)能(neng)力建設(she)。持續加(jia)強(qiang)各級司法行(xing)(xing)政機關管(guan)(guan)理(li)(li)(li)干部和(he)行(xing)(xing)業(ye)(ye)協會管(guan)(guan)理(li)(li)(li)人員能(neng)力建設(she),開展資質認定(ding)有關理(li)(li)(li)論學習、案例剖析、經驗交流(liu)等活動,加(jia)快培養一批熟悉政策,精通(tong)業(ye)(ye)務的高水(shui)平管(guan)(guan)理(li)(li)(li)人才(cai)隊伍。加(jia)強(qiang)信息化手(shou)段(duan)(duan)在(zai)管(guan)(guan)理(li)(li)(li)工作中(zhong)的運(yun)用,完善(shan)司法鑒定(ding)管(guan)(guan)理(li)(li)(li)信息系統,不斷豐(feng)富行(xing)(xing)業(ye)(ye)監管(guan)(guan)手(shou)段(duan)(duan),切(qie)實(shi)提高監管(guan)(guan)效率(lv)和(he)水(shui)平。充分發(fa)揮行(xing)(xing)業(ye)(ye)協會自律管(guan)(guan)理(li)(li)(li)職能(neng),完善(shan)行(xing)(xing)政處罰與(yu)行(xing)(xing)業(ye)(ye)懲戒銜接,形成行(xing)(xing)政管(guan)(guan)理(li)(li)(li)與(yu)行(xing)(xing)業(ye)(ye)自律管(guan)(guan)理(li)(li)(li)良(liang)性結(jie)合的管(guan)(guan)理(li)(li)(li)模式,多層次提升行(xing)(xing)業(ye)(ye)監管(guan)(guan)水(shui)平。
(八)加(jia)(jia)強監(jian)(jian)督管(guan)(guan)理力度。司法行政機關要(yao)(yao)(yao)充分利用全面評查、能力驗證(zheng)、“雙隨(sui)機、一(yi)公開”監(jian)(jian)督抽查等手段,進一(yi)步加(jia)(jia)強對司法鑒定(ding)(ding)(ding)(ding)(ding)(ding)(ding)機構(gou)執業行為的監(jian)(jian)管(guan)(guan),對于在監(jian)(jian)管(guan)(guan)中(zhong)發現不再符(fu)合資(zi)質(zhi)認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)條(tiao)件和(he)要(yao)(yao)(yao)求(qiu)的,應(ying)當(dang)及(ji)時通(tong)報(bao)市場監(jian)(jian)管(guan)(guan)部門,在整改(gai)完成(cheng)前不得開展對應(ying)專(zhuan)業領域司法鑒定(ding)(ding)(ding)(ding)(ding)(ding)(ding)業務。市場監(jian)(jian)管(guan)(guan)部門要(yao)(yao)(yao)加(jia)(jia)強對司法鑒定(ding)(ding)(ding)(ding)(ding)(ding)(ding)檢(jian)測(ce)實驗室(shi)的事(shi)中(zhong)事(shi)后監(jian)(jian)管(guan)(guan),督促(cu)其基(ji)本條(tiao)件和(he)技術能力能夠持續符(fu)合資(zi)質(zhi)認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)條(tiao)件和(he)要(yao)(yao)(yao)求(qiu)。要(yao)(yao)(yao)督促(cu)鑒定(ding)(ding)(ding)(ding)(ding)(ding)(ding)機構(gou)規范資(zi)質(zhi)認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)標(biao)(biao)(biao)志(zhi)(zhi)使用,經資(zi)質(zhi)認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)的相關檢(jian)測(ce)實驗室(shi)為司法鑒定(ding)(ding)(ding)(ding)(ding)(ding)(ding)活動提供數據(ju)支(zhi)撐的,應(ying)按照(zhao)資(zi)質(zhi)認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)有關規定(ding)(ding)(ding)(ding)(ding)(ding)(ding)出具檢(jian)測(ce)報(bao)告(記載檢(jian)驗檢(jian)測(ce)數據(ju)、結果(guo)的書(shu)面資(zi)料),并加(jia)(jia)蓋資(zi)質(zhi)認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)標(biao)(biao)(biao)志(zhi)(zhi),司法鑒定(ding)(ding)(ding)(ding)(ding)(ding)(ding)意見(jian)書(shu)上(shang)無需(xu)標(biao)(biao)(biao)注資(zi)質(zhi)認(ren)(ren)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)標(biao)(biao)(biao)志(zhi)(zhi);檢(jian)測(ce)報(bao)告應(ying)當(dang)歸入鑒定(ding)(ding)(ding)(ding)(ding)(ding)(ding)檔案并根據(ju)委托人(ren)要(yao)(yao)(yao)求(qiu)提供。
